Le présent volume tient sa raison d’être d’un Congrès international francophone organisé le 18 décembre 2015 par le Département de Sciences Économiques et Politiques de l’Université de la Vallée d’Aoste, la seule Université du monde fonctionnant en français et italien. Ce congrès a été la dernière étape d’un parcours commun de recherche et conférences entrepris sous la coordination des Directeurs de la publication, à partir de 2014, dans leurs Universités d’appartenance. Ce parcours a impliqué de nombreux chercheurs reconnus des plus prestigieuses Universités italiennes, françaises et de la Francophonie. Les résultats scientifiques obtenus dans le cadre de cette recherche et à la suite du Congrès final à Aoste sont mis à disposition de la Communauté scientifique grâce au présent volume, qui trouve naturellement sa place dans la collection éditoriale du CIDOIE dédiée au droit international de l’économie. L’activité de recherche dans un premier temps et l’organisation du Congrès dans un deuxième temps se sont en effet déroulées dans le cadre des objectifs statutaires du Centre Interuniversitaire pour le Droit des Organisations Internationales Économiques (CIDOIE). À cette occasion l’activité a impliqué en particulier le Département de Sciences Économiques et Politiques de l’Université de la Vallée d’Aoste et le Département d’Études Juridiques « Angelo Sraffa » de l’Université Bocconi de Milan, qui compte de nombreux juristes francophones : ces départements sont tous deux Adhérents au Centre. Le défi consistait à affronter des thèmes très actuels et intellectuellement stimulants, souvent complexes et situés aux frontières des territoires traditionnellement cultivés par les juristes : cette provocation a été accueillie de manière enthousiaste et déterminée par tous les participants à la recherche. À animer les chercheurs, outre la passion pour le droit international de l’économie, a été le sentiment commun de proximité ou d’adhésion à une Francophonie vécue également comme un courant de pensée soucieux de la préservation des identités culturelles, du respect et de la promotion des droits fondamentaux de la personne. Le haut patronage concédé à cette activité par l’Université Senghor de la Francophonie a particulièrement honoré ce travail : la préface de l’ouvrage faite par Albert Lourde, Recteur de l’Université Senghor jusqu’à cette année, et la conclusion de ce volume par Denis Fadda, Président honoraire de l’Académie des Sciences d’Outre-Mer, qui représentait le Conseil d’Administration de l’Université Senghor au Congrès d’Aoste en 2015, portent témoignage magistral de l’importance et de l’originalité de l’engagement avec lequel l’ensemble de la Francophonie Universitaire s’est avancée pour affirmer les valeurs juridiques de la solidarité et de l’éthique face aux défis économiques et sociaux que les États et leur population connaissent dans le monde contemporain. Les contributions au présent volume sont en français et en italien et portent, en ce sens, le témoignage vivant d’une diversité culturelle francophone, italienne, mais aussi franco-italienne : elles sont intentionnellement voulues comme un hommage au bilinguisme qui caractérise la Région Autonome Vallée d’Aoste et l’Université siège du colloque de décembre 2015 : cette publication en deux langues a donc pour objectif clair d’avoir une diffusion dans les communautés scientifiques aussi bien francophones qu’italophones. Nos remerciements vont enfin au Dott. Stefano Saluzzo, boursier-chercheur à l’Université de la Vallée d’Aoste, pour sa collaboration généreuse et précise, qui a permis le respect de l’engagement pris par les Auteurs de publier rapidement ce volume.

Transnational business activities are important drivers of growth for developing and the least developed countries. However, they can also negatively impact the enjoyment of human rights. In some cases, multinational enterprises (MNEs) have even been accused of grave human rights abuses in the territory of the states where their subsidiaries operate. Since the parent companies of many MNEs are incorporated under the law of European states, those countries’ domestic law and the European legal framework play a crucial role in establishing how their activities should be conducted – also throughout their supply chains – and which remedies will be available when corporate human rights violations occur. In recent years, the European Union, the Council of Europe and their Member States have been adopting policies and legislation to ensure respect for human rights by businesses and have developed a body of related case law. These legal instruments can be considered the European responses to the challenges posed at international-law level, and they constitute the focus of research of this book. Through its collected chapters – written by scholars and practitioners under the direction of the editor, Angelica Bonfanti – the book identifies the European solutions to the business and human rights international legal issues, provides an overall assessment of their effectiveness, and examines their potential evolution.

Most non-governmental organizations (NGOs) in the Arab world have traditionally been active in the areas of social work and charity, often within a religious or communal framework. But recently, many of these organizations have become the forum for conflicts between different political trends, while others tackle political problems such as human rights or democratic issues. Facing the rejuvenated NGO scene in the Arab world, public authorities remain torn between support for the concerns of civil society and the traditional mode of management, which does not delegate, consult, or decentralize. Can NGOs in the Arab world be considered full-fledged actors of governance and of national and local development? Is the relationship between NGOs and public authorities at the national and local level one of partnership or opposition and competition?
