In the age of economic globalisation, do art and heritage matter? Once the domain of elitist practitioners and scholars, the governance of cultural heritage and the destiny of iconic artefacts have emerged as the new frontier of international law, making headlines and attracting the varied interests of academics and policy-makers, museum curators and collectors, human rights activists and investment lawyers and artists and economists, just to mention a few. The return of cultural artefacts to their legitimate owners, the recovery of underwater cultural heritage and the protection and promotion of artistic expressions are just some of the pressing issues addressed by this book. Contemporary intersections between art, cultural heritage and the market are complicated by a variety of ethical and legal issues, which often describe complex global relations. Should works of art be treated differently from other goods? What happens if a work of art, currently exhibited in a museum, turns out to have originally been looted? What is the relevant legal framework? What should be done with ancient shipwrecks filled with objects from former colonies? Should such objects be kept by the finders? Offering a negative definition of art in relation to the concept of culture, this book establishes the concept of ‘art/culture’ to describe the unity of these two fields around named-labour, idealised creative subjectivity and surplus signification. Contending a conceptual and social reality of a combined ‘art/culture’ , this book demonstrates that the failure to appreciate the dynamic totality of art and culture by its purported negators is due to almost all existing critiques of art and culture being defences of a ‘true’ art or culture against ‘inauthentic’ manifestations, and art thus ultimately restricting creativity to the service of the bourgeois commodity regime. While the evidence that art/culture enables commodification has long been available, the deduction that art/culture itself is fundamentally of the world of commodification has failed to gain traction. By applying a nuanced analysis of both commodification and the larger systems of ideological power, the book considers how the ‘surplus’ of art/culture is used to legitimate the bourgeois status quo rather than unravel it. It also examines possibilities for a post-art/culture world based on both existing practices that challenge art/culture identity as well as speculations on the integration of play and aesthetics into general social life. An out-and-out negation of art and culture, this book offers a unique contribution to the cultural critique landscape.

There are two oppositional narratives in relation to telling the story of indigenous peoples and minorities in relation to globalization and intellectual property rights. The first, the narrative of Optimism, is a story of the triumphant opening of brave new worlds of commercial integration and cultural inclusion. The second, the narrative of Fear, is a story of the endangerment, mourning, and loss of a traditional culture. While the story of Optimism deploys a rhetoric of commercial mobilization and “innovation,” the story of Fear emphasizes the rhetoric of preserving something “pure” and “traditional” that is “dying.” Both narratives have compelling rhetorical force, and actually need each other, in order to move their opposing audiences into action. However, as Picart shows, the realities behind these rhetorically framed political parables are more complex than a simple binary. Hence, the book steers a careful path between hope rather than unbounded Optimism, and caution, rather than Fear, in exploring how law functions in and as culture as it contours the landscape of intellectual property rights, as experienced by indigenous peoples and minorities. Picart uses, among a variety of tools derived from law, critical and cultural studies, anthropology and communication, case studies to illustrate this approach. She tracks the fascinating stories of the controversies surrounding the ownership of a Taiwanese folk song; the struggle over control of the Mapuche’s traditional land in Chile against the backdrop of Chile’s drive towards modernization; the collaboration between the Kani tribe in India and a multinational corporation to patent an anti-fatigue chemical agent; the drive for respect and recognition by Australian Aboriginal artists for their visual expressions of folklore; and the challenges American women of color such as Josephine Baker and Katherine Dunham faced in relation to the evolving issues of choreography, improvisation and copyright. The book also analyzes the cultural conflicts that result from these encounters between indigenous populations or minorities and majority groups, reflects upon the ways in which these conflicts were negotiated or resolved, both nationally and internationally, and carefully explores proposals to mediate such conflicts.

This complex story, informed by rich archival material and interviews, details the triumph of local arts practice and community over the insistent cultural nation-building of Australia’s capital. It exposes local arts as a vital force in Canberra’s development and uncovers the influence of women in the growth of its visual arts culture. A broad illumination of the city-wide development of arts and culture from the 1920s to 2001 is combined with the story of Bitumen River Gallery and its successor Canberra Contemporary Art Space from 1978 to 2001. This history traces the growth of the arts from a community-led endeavour, through a period of responses to social and cultural needs, and ultimately to a humanising local practice that transcended national and international boundaries.
