“The richness, clarity and nuances of the structure and methodology followed by the contributors make the book a very valuable tool for students... seeking to obtain a general understanding of the market and how it is regulated.” – Ligia Catherine Arias Barrera, Banking & Finance Law Review The fully updated edition of this user-friendly textbook continues to systematise the European law governing capital markets and examines the underlying concepts from a broadly interdisciplinary perspective. The 3rd edition deals with 3 central developments: the project of the capital markets union; sustainable finance; and the further digitalisation of financial instruments and securities markets. The 1st chapter deals with the foundations of capital markets law in Europe, the 2nd explains the basics, and the 3rd examines the regime on market abuse. Chapter 4 explores the disclosure system and chapter 5 short-selling and high-frequency trading. The role of intermediaries, such as financial analysts, rating agencies, and proxy advisers, is described in chapter 6. Chapter 7 explains compliance and corporate governance in investment firms and chapter 8 illustrates the regulation of benchmarks. Finally, chapter 9 deals with public takeovers. Throughout the book emphasis is placed on legal practice, and frequent reference is made to the key decisions of supervisory authorities and courts. This is essential reading for students involved in the study of capital markets law and financial law.

Is The Euro Secure written by Hermann Witte and has been published by LIT Verlag Münster this book supported file pdf, txt, epub, kindle and other format this book has been release on 2016 with Equilibrium categories.

The economic crisis in Greece led to discussions on whether the euro was secure. To answer this question, first the functions of money, the theoretical basis of monetary policy, and the criteria for the security of a currency must be discussed. The crisis demonstrates that neither Keynesian interest control nor the monetarisms control of the money amount can solve the problem that led up to the crisis. The new approach of monetary theory discussed here is based on equilibriums of goods, money, and labor markets. The found equilibrium solution is not identity (approach of monetarism) and not "equilibrium with unemployment" (Keynes). But the approach in this book leads to a secure currency. Guaranteeing third country national workers robust equal treatment with regard to working conditions and pay is a crucial condition for avoiding social dumping, exploitation, and other reasons for regime shopping within the EU. However, Member States are still reluctant to compromise control of their borders and their labour markets. The EU legislation adopted is, as a result, fragmented and full of solutions that give Member States an extensive margin of room for manoeuvre. In this book six distinguished European labour law academics discuss how three EU directives on labour migration – the Single Permit Directive, the Blue Card Directive, and the Directive on Seasonal Employment – interact with the labour migration systems of France, Germany, Italy, Poland, and Sweden – five countries with very different characteristics and approaches to implementation. Concrete issues dealt with in each country include the following: – conditions for granting work permits; - reasons for withdrawing a work permit; - how long a migrant worker can stay; - whether a migrant worker can bring his or her family; - employment and labour rights of migrant workers; - migrant workers' access to social rights; - how a migrant worker may enforce rights; - sanctions for violations of applicable provisions; and - potential for permanent status for a migrant worker. For each of these issues the authors analyse to what extent national legislators have been ready to adapt their national systems in order to fulfill the aims of the EU directives. They also identify unintended, or at least not explicit, effects of the implementation process. The authors clearly reveal whether the ambitions of the EU when initiating this process can be detected in the implementation process, and how implementation of the three directives have changed and could change national law on these issues. As the first in-depth analysis of how the intersection of migration and labour law and their impact on labour and employment relations play out in the EU context this book brings important insights to the growing literature in this field. The analysis will be of particular interest to national legislators, but is also sure to be warmly welcomed by academics and practitioners in fields related to labour and employment and migration.

The New Regulatory Framework For Consumer Dispute Resolution written by Pablo Cortés and has been published by Oxford University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2016-12-01 with Law categories.

Consumer out-of-court redress in the European Union is experiencing a significant transformation; indeed the current changes are the most important that have occurred in the history of the EU. This is due to the recent implementation of the Alternative Dispute Resolution (ADR) Directive 2013/11/EU and the Online Dispute Resolution (ODR) Regulation (EU) 2013/524. The Directive ensures the availability of quality ADR schemes and sets information obligations on businesses, and the Regulation enables the resolution of consumer disputes through a pan European ODR platform. The New Regulatory Framework for Consumer Dispute Resolution examines the impact of the new EU law in the field of consumer redress. Part I of the volume examines the new European legal framework and the main methods of consumer redress, including mediation, arbitration, and ombudsman schemes. Part II analyses the implementation of the ADR Directive in nine Member States with very different legal cultures in consumer redress, namely: Belgium, Ireland, Italy, Germany, France, Portugal, Spain, the Netherlands and the UK, as well as the distinct approach taken in the US. Part III evaluates new trends in consumer ADR (CDR) by identifying best practices and looking at future trends in the field. In particular, it offers a vision of the future of CDR which is more than a mere dispute resolution tool, it poses a model on dispute system design for CDR, it examines the challenges of cross-border disputes, it proposes a strategy to promote mediation, and it identifies good practices of CDR and collective redress. The book concludes by calling for the mandatory participation of traders in CDR.

Philanthropy In Practice written by Ekkehard Th?mler and has been published by Taylor & Francis this book supported file pdf, txt, epub, kindle and other format this book has been release on 2017-07-06 with Business & Economics categories.

Philanthropic foundations are experiencing a crisis of professional identity. They attract considerable hopes due to an unusually high degree of independence and freedom of manoeuvre, which theoretically places them in a privileged position to find novel solutions to societies’ most severe and intractable problems. However, the field is said to suffer from a pervasive lack of orientation as to how these aspirations can be realized. Compared to other professions, it can be said that there exists neither reliable knowledge nor established practices which might guide the strategy development and the daily practice of foundations. This void is frequently filled by changing fads which present easy to grasp recipes and often make bold promises of how foundations can change the world. Yet, none of them has ever met these expectations. Philanthropy in Practice shows how philanthropic organizations can effectively address this predicament. Drawing on the public philosophy of Pragmatism, it argues that, to be effective, they need to go for the solution of social problems of middle range. The book puts at center stage the crucial role of niches in terms of bounded, protected and stable social spaces which are rich in resources. They render possible the experiments required to develop effective interventions and facilitate the retention of novel solutions to social problems. The model builds upon, and is illustrated by four in-depth case studies from the UK, Germany and Switzerland. With its sharp analytical eye and substantial evidence, Philanthropy in Practice will reshape the way we think about the questions of what impact philanthropy can reasonably hope to achieve, and by which means.

Urban Displacements written by Susanne Soederberg and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2020-12-31 with Political Science categories.

With an eye to further our understanding of everyday life in global capitalism, Urban Displacements provides the first systemic critical political economy analysis of low-income rental housing and social dislocations, combining both theoretical advancements and detailed empirical studies, centering on Berlin, Dublin and Vienna. Soederberg pushes beyond dominant debates by treating low-rent housing as a unique commodity that provides a necessary place for the societal reproduction of labour power whilst being integrated into the global dynamics of capitalism. She argues that historical and geographical configurations of monetized governance, including landlords, employers and inter-scalar state practices, have served to reproduce urban displacements and obfuscate their gendered, class and racialized underpinnings. The outcome is the everyday facilitation and normalization of urban poverty and social marginalization on one side, and capital accumulation on the other. Building on Soederberg’s previous book Debtfare States and the Poverty Industry, this accessible and interdisciplinary text will be useful to academics and students in political science, sociology, geography, urban studies, labour studies, European studies and gender studies.

Managing Interdependencies In Federal Systems written by Johanna Schnabel and has been published by Springer Nature this book supported file pdf, txt, epub, kindle and other format this book has been release on 2020-02-18 with Political Science categories.

Intergovernmental councils have emerged as the main structures through which the governments of a federation coordinate public policy making. In a globalized and complex world, federal actors are increasingly interdependent. This mutual dependence in the delivery of public services has important implications for the stability of a federal system: policy problems concerning more than one government can destabilize a federation, unless governments coordinate their policies. This book argues that intergovernmental councils enhance federal stability by incentivizing governments to coordinate, which makes them a federal safeguard. By comparing reforms of fiscal and education policy in Australia, Canada, Germany, and Switzerland, this book shows that councils’ effectiveness as one of federalism’s safeguards depends on their institutional design and the interplay with other political institutions and mechanisms. Federal stability is maintained if councils process contentious policy problems, are highly institutionalized, are not dominated by the federal government, and are embedded in a political system that facilitates intergovernmental compromising and consensus-building.
