This collection of essays engages with a central theme in scholarship on EU citizenship – the emancipation of certain citizens, the alienation of others – and seeks to expand its horizons to interrogate whether similar debates and trends can be identified in other fields of European integration. The focus of the book is distinctly citizen focused. It delivers the potential for the opening out of analysis of the implications of European citizenship beyond the parameters of Articles 18-25 TFEU and beyond the disciplinary confines of legal analysis alone. The book construes 'EU citizenship' in its broadest sense, and explores the extent to which the European citizen is, or indeed is not, genuinely at the heart of EU law and policy-making. The French law of international arbitration has a beginning (1963) and a culminating point (2007), but fortunately it does not have an ending. Indeed, it does not cease to evolve, to improve, to perfect itself. Thus it invites one to carefully observe it. But before undertaking this careful observation by annually identifying the most important decisions, as this collection has been doing since 2008, it is important to recall the origins of French law on international arbitration, how it was built, and in so doing, predict where it is heading. Looking into the past to anticipate the future, that is also the interest of a book like the present one. This selection, necessarily subjective, is also shaped by the advantages that a retrospective look offers. The benefit of hindsight allows one to confidently distinguish between the decisions that deserve mention and those which did not make it into history. Only the former are printed in the following pages, but all of such decisions are included. Conversely, all decisions from 2008 onwards will be methodically published in the annual reports of this collection, of which two editions have already been released for the years 2008 and 2009. Aimed for practitioners and academics alike, the knowledge of French case law is indispensable to understanding international arbitration and its important influence around the world.

The development of an autonomous English public law has been accompanied by persistent problems - a lack of systematic principles, dissatisfaction with judicial procedures, and uncertainty about the judicial role. It has provoked an ongoing debate on the very desirability of the distinctionbetween public and private law. In this debate, a historical and comparative perspective has been lacking. A Continental Distinction in the Common Law introduces such a perspective. It compares the recent emergence of a significant English distinction with the entrenchment of the traditional Frenchdistinction. It explains how persistent problems of English public law are related to fundamental differences between the English and French legal and political traditions, differences in their conception of the state administration, their approach to law, their separation of powers, and theirjudicial procedures in public-law cases. The author argues that a satisfactory distinction between public and private law depends on a particular legal and political context, a context which was evident in late nineteenth-century France and is absent in twentieth-century England. He concludes byidentifying the far-reaching theoretical, institutional, and procedural changes required to accommodate English public law.

Personal status laws remain a highly politicized area of debate in the Middle East, as the arena in which the contentious issues of women's rights, religion and minority groups meet. This is especially so when it comes to divorce. In Tunisia, with the moderate Islamist party Ennahda winning the first elections following the 2011 revolution, questions of religion in public life have gained greater primacy. The country is often hailed for its progressive personal status code, seen as an exception to the practice in many other Muslim countries. Polygamy is banned, for example, and in divorce cases there is gender equality. However, Tunisia's legal system contains many gaps and leaves much room for interpretation. Bearing in mind this importance of the role of Islam in judicial courts, Maaike Voorhoeve investigates whether the more progressive, and ostensibly secular, principles enshrined in Tunisia's Personal Status Code of 1956 are in fact adhered to in divorce cases. And if not, whether judges frequently turn to the Sharia, custom or societal norms as their primary sources of guidance. Through extensive research in the Tunisian courts, Voorhoeve investigates the different types of divorce, the arguments presented to the court and the consequent legal decisions made. She focuses on the role of female judges, testing the assumption that they adjudicate in a more gender-neutral way and examining the impact they have had on Tunisian legal culture and through this, Tunisian society. Gender and Divorce Law in North Africa therefore sheds light on the wide-reaching debate throughout North Africa and the Middle East concerning the role of Islam and Sharia in the public, political, legal and private spheres. This debate, which often pits secularists against Islamists, but is in reality much more nuanced, is key in a variety of fields, including Middle East studies and Islamic law.
