L’apparition de nouveaux types d’armes et de guerres, dans ces dernières décennies, appelle un complet renouveau du droit international. Ainsi des drones, dont le statut létal n’est pas reconnu. Ou des cyberattaques, auxquelles on n’apporte pas toujours les ripostes pertinentes faute d’un cadre juridique adéquat. Cet ouvrage présente d’abord les normes qui régissent la guerre face à l’interdiction du recours à la force qu’édicte la Charte de l’ONU. Il expose ensuite les sources de ce droit, et notamment l’apport des religions monothéistes – islam, judaïsme et christianisme – pour la conduite des combattants. Faisant le point sur l’ensemble de règles relatives aux différents aspects de la guerre, il souligne quelles sont les armes prohibées car trop inhumaines ou barbares. Il montre en quoi la perfidie – représailles – est interdite alors que la ruse est autorisée. Enfin, les normes relatives à l’achèvement des conflits sont essentiellement le fruit d’une pratique déjà ancienne. Elles tendent à aménager le retour à la paix. Mario Bettati, professeur agrégé des facultés de droit, ancien doyen, a été conseiller de Bernard Kouchner, ministre des Affaires étrangères, de Georges Kiejman, ministre délégué aux Affaires étrangères, et de Rama Yade, secrétaire d’État aux Droits de l’homme. « Droit de la guerre ». L’expression peut surprendre. La guerre ne serait-elle pas le non-droit, et le droit ne serait-il pas synonyme de paix ? À cette question, il convient de répondre par la négative. La guerre est une institution juridique. Le droit de la guerre existe, aussi ancien que la guerre et que le droit international, dont il constitue le coeur historique. Le XXe siècle, du Pacte de la Société des nations à la Charte des Nations unies, n’a pas davantage aboli le droit de guerre, ni transformé le jus ad bellum en jus contra bellum et le jus in bello en « droit international humanitaire ». Croisant droit et polémologie, le présent traité dissipe l’illusion. Portant sur les conflits armés internationaux comme sur les conflits armés internes, il expose, explique et reconstruit, l’ensemble du droit international contemporain relatif à l’emploi de la force armée, aussi bien les auteurs de la belligérance que ses acteurs, ses buts et moyens, ses théâtres d'opération et ses régimes, proposant en outre une analyse critique de la responsabilité réparatrice et punitive.
