David Milgaard was a troubled kid, and he got into lots of trouble. Unfortunately, that made it easy for the Saskatoon police to brand him as a murderer. At seventeen, David Milgaard was arrested, jailed, and convicted for the rape and murder of a young nursing assistant, Gail Miller. He was sent to adult prison for life. Throughout his twenty-three years in prison, David maintained that he was innocent and refused to admit to the crime, even though it meant he was never granted parole. Finally, through the incredible determination of his mother and new lawyers who believed in him, David was released and proven not guilty. Astonishingly, in hindsight the real murderer was obvious from the start. This is the true story of how bad decisions, tunnel vision, poor representation, and outright lying and coercion by those within the justice system caused a tragic miscarriage of justice. It also shows that wrongs can be righted and amends made. [Fry Reading Level - 4.3

Sentenced To Death written by David Guest and has been published by Univ. Press of Mississippi this book supported file pdf, txt, epub, kindle and other format this book has been release on 2007-11-26 with Literary Criticism categories.

The criminal justice system in America is as powerful a shaper of history and society as its better-known counterparts--the military, politics, government, and technology. In a country that lacks a mandatory death sentence for specific crimes, the American strategy for execution proves to be based more upon distinctions between offenders than upon distinctions between offenses. Five important novels--McTeague, An American Tragedy, Native Son, In Cold Blood and The Executioner's Song--bring readers a vivid awareness of America's punitive codes. Each details the story of a life that leads to the gallows. Sentenced to Death places these works against the historical background of crime and capital punishment in America, a nation where public discourse on crime is dominated by images of the electric chair and the gas chamber, by maximum security prisons, by hardened convicts out on parole. Such images, in turn mirror and shape the exercise of punitive power. This probing look at capital punishment in execution novels and in real-life media accents the poles of punitive power. Such a comparison of literary works with confrontational journalism and court records also brings revealing insight into the long-term debate on capital punishment in American culture.

It was meant to be a two-week holiday to celebrate her sister's birthday, but for Schapelle Corby it ended up a waking nightmare. Arrested at Denpasar airport after marijuana was found in her luggage, she became the victim of every traveller's darkest fear. Over four kilograms of drugs had been planted in her bag after she'd checked it in and she was forced to face the consequences of someone else's crime in a country where the penalties for drug smuggling are among the harshest in the world. Her trial and conviction became one of the biggest news stories of the decade and her family watched in horror as she was sentenced to 20 years in jail. Yet despite the huge media coverage, the one voice the public never properly heard was Schapelle's. Now, in this compelling book, she tells her own story: of being wrenched from a carefree holiday and incarcerated in a stinking police cell and of learning to survive - in the squalor, discomfort and violence of an Indonesian jail. It is an account like no other and will be one of the most unforgettable books you'll ever read.

The Lived Sentence written by Maggie Hall and has been published by Palgrave Macmillan this book supported file pdf, txt, epub, kindle and other format this book has been release on 2018-07-18 with Social Science categories.

This book examines the lives of the sentenced to argue that 'sentencing' should be re-conceived to consider the human perspective. It combines a range of modern criminological and legal theories together with interviews with prisoners in New South Wales, to examine their lives during and beyond completing the terms of imprisonment, for a more continuous and coherent perspective on the process of 'sentencing'. This book makes a strong argument for the practical advantages of listening to the voices of the sentenced and it is therefore a useful tool for the correctional community engaged in providing services and programmes to reduce recidivism. A methodological and well-researched text, this book will be of particular interest to scholars of criminal justice and the penal system, as well as policy makers and practitioners.

“Some guys don’t break any rules. They do their jobs, they go to school, they don’t commit any infractions, they keep their cells clean and tidy, and they follow the rules. And usually those are our LWOPs [life without parole]. They’re usually our easiest keepers.” Too Easy to Keep directs much-needed attention toward a neglected group of American prisoners—the large and growing population of inmates serving life sentences. Drawing on extensive interviews with lifers and with prison staff, Too Easy to Keep charts the challenges that a life sentence poses—both to the prisoners and to the staffers charged with caring for them. Surprisingly, many lifers show remarkable resilience and craft lives of notable purpose. Yet their eventual decline will pose challenges to the institutions that house them. Rich in data, Too Easy to Keep illustrates the harsh consequences of excessive sentences and demonstrates a keen need to reconsider punishment policy.

Most people assume that criminal offenders have only been convicted of a single crime. However, in reality almost half of offenders stand to be sentenced for more than one crime. The high proportion of multiple crime offenders poses a number of practical and theoretical challenges for the criminal justice system. For instance, how should courts punish multiple offenders relative to individuals who have been sentenced for a single crime? How should they be punished relative to each other? Sentencing Multiple Crimes discusses these questions from the perspective of several legal theories. This volume considers questions such as the proportionality of the crimes committed, the temporal span between the crimes, and the relationship between theories about the punitive treatment of recidivists and multiple offenders. Contributors from around the world and in the fields of legal theory, philosophy, and psychology offer their perspectives to the volume. A comprehensive examination of the dynamics involved with sentencing multiple offenders has the potential to be a powerful tool for legal scholars and professionals, particularly given the practical importance of the topic and the relative dearth of research about punishment of multiple offense cases.

In California over 300 youth have been sentenced to life without parole. This update presents current data on the number of youth sentenced to life without parole in California, and details significant legal changes in recent years. It also describes the cases of several young people convicted of murder: two sentenced to parole-eligible sentences who served many years in prison and are now out and contributing to their communities, and two sentenced to life without parole who will die in prison. Law and public opinion about life sentences for youth have evolved in recent years. Experience and a growing body of scientific evidence confirm there is tremendous emotional and mental growth during the late teens, and that young people differ from adults. As US Supreme Court Justice John Paul Stevens has stated: "Society changes. Knowledge accumulates. We learn, sometimes, from our mistakes..." California's law permitting juveniles to be sentenced to life without parole for murder was enacted before major advances in understanding adolescent brain development, and fails to recognize that teenagers are particularly amenable to change and rehabilitation. All youth should have the chance to prove they have changed, and to earn parole.

Florence Maybrick was the first American woman to be sentenced to death in England--for murdering her husband, a crime she almost certainly did not commit. Her 1889 trial was presided over by an openly misogynist judge who was later declared incompetent and died in an asylum. Hours before Maybrick was to be hanged, Queen Victoria reluctantly commuted her sentence to life in prison--in her opinion a woman who would commit adultery, as Maybrick had admitted, would also kill her husband. Her children were taken from her; she never saw them again. Her mother worked for years to clear her name, enlisting the president of the United States and successive ambassadors, including Robert Todd Lincoln. Decades later, a gruesome diary was discovered that made Maybrick's husband a prime Jack the Ripper suspect.
