This book offers a transdisciplinary perspective on the question of how political legitimacy is constructed in the increasingly contested postnational setting of the European Union. Drawing on the example of the controversy about the EU constitution and the use of ‘EU constitution speak’ in commentaries published by Polish and French broadsheets, it reveals the transformation that constructions of political authority and association undergo when they are being transposed from the discourse field of multilateral negotiation to that of national news media. Through an original combination of the linguistic theory of discourse developed in Critical Discourse Analysis, Bourdieu’s field theory and notion of symbolic power, and political thought on polity-building, it develops a framework for the discourse study of legitimation and Europeanisation, and proposes applications beyond the case studies in the book.To students of European integration, it demonstrates the potential these concepts have for unravelling the implicit practices of postnational polity building. Discourse researchers, on the other hand, will discover how detailed text analyses gain significance in debates related to the macro level of political organisation when guided by sociological and political theory.

This second volume of ReConFort, published open access, addresses the decisive role of constitutional normativity, and focuses on discourses concerning the legal role of constitutional norms. Taken together with ReConFort I (National Sovereignty), it calls for an innovative reassessment of constitutional history drawing on key categories to convey the legal nature of the constitution itself (national sovereignty, precedence, justiciability of power, judiciary as constituted power). In the late 18th and early 19th centuries, constitutional normativity began to complete the legal fixation of the entire political order. This juridification in one constitutional text resulted in a conceptual differentiation from ordinary law, which extends to alterability and justiciability. The early expressions of this ‘new order of the ages’ suggest an unprecedented and irremediable break with European legal tradition, be it with British colonial governance or the French ancien régime. In fact, while the shift to constitutions as a hierarchically ‘higher’ form of positive law was a revolutionary change, it also drew upon old liberties. The American constitutional discourse, which was itself heavily influenced by British common law, in turn served as an inspiration for a variety of constitutional experiments – from the French Revolution to Napoleon’s downfall, in the halls of the Frankfurt Assembly, on the road to a unified Italy, and in the later theoretical discourse of twentieth-century Austria. If the constitution states the legal rules for the law-making process, then its Kelsian primacy is mandatory. Also included in this volume are the French originals and English translations of two vital documents. The first – Emmanuel Joseph Sieyès’ Du Jury Constitutionnaire (1795) – highlights an early attempt to reconcile the democratic values of the French Revolution with the pragmatic need to legally protect the Revolution. The second – the 1812 draft of the Constitution of the Kingdom of Poland – presents the ‘constitutional propaganda’ of the Russian Tsar Alexander I to bargain for the support of the Lithuanian and Polish nobility. These documents open new avenues of research into Europe’s constitutional history: one replete with diverse contexts and national experiences, but above all an overarching motif of constitutional decisiveness that served to complete the juridification of sovereignty. Systemic Functional Political Discourse Analysis: A Text-based Study is the first book which takes a comprehensive systemic functional perspective on political discourse to provide a complete, integrated, exhaustive, systemic and functional description and analysis. Based on the political discourses of the Umbrella Movement – the largest public protest in the history of Hong Kong, which occupies a unique political situation in the world: a post-colonial society like many other Asian societies and yet unlike the others, it is a Special Administrative Region of China. Though it enjoys a high degree of autonomy under the principle of ‘One Country, Two Systems’, it is still confined to being part of the ‘One Country’. The book demonstrates how a systemic functional approach can provide a comprehensive, thorough, and insightful analysis of the political discourse from four co-related and complementary approaches: contextual, discourse semantic, lexicogrammatical and historical. Apart from a thorough discussion of various systemic functional conceptions, it provides examples of various analyses from a SF perspective, including contextual parameters, registerial analysis, semantic discourse analysis, appraisal analysis, and discusses important issues in political discourse, including negotiation of self-identity, association of language, power and institutional role, and expression of ‘evidentiality’ and ‘subjectivity’. Bringing a postcolonial perspective to UK constitutional debates and including a detailed and comparative engagement with the constitutions of Britain’s ex-colonies, this book is an original reflection upon the relationship between the written and the unwritten constitution. Can a nation have an unwritten constitution? While written constitutions both found and define modern nations, Britain is commonly regarded as one of the very few exceptions to this rule. Drawing on a range of theories concerning writing, law and violence (from Robert Cover to Jacques Derrida), Constitutions makes a theoretical intervention into conventional constitutional analyses by problematizing the notion of a ‘written constitution’ on which they are based. Situated within the frame of the former British empire, this book deconstructs the conventional opposition between the ‘margins’ and the ‘centre’, as well as between the ‘written’ and ‘unwritten’, by paying very close, detailed attention to the constitutional texts under consideration. Pryor argues that Britain’s ‘unwritten’ constitution and ‘immemorial’ common law only take on meaning in a relation of difference with the written constitutions of its former colonies. These texts, in turn, draw on this pre-literate origin in order to legitimize themselves. The ‘unwritten’ constitution of Britain can therefore be located and dislocated in postcolonial written constitutions. Constitutions is an excellent addition to the bookshelves of all students of the philosophy of law, political theory, constitutional and administrative law and jurisprudence.
