How access to resources and policymaking powers determines the balance of power between the legislative and executive branches The specter of unbridled executive power looms large in the American political imagination. Are checks and balances enough to constrain ambitious executives? Checks in the Balance presents a new theory of separation of powers that brings legislative capacity to the fore, explaining why Congress and state legislatures must possess both the opportunities and the means to constrain presidents and governors—and why, without these tools, executive power will prevail. Alexander Bolton and Sharece Thrower reveal how legislative capacity—which they conceive of as the combination of a legislature’s resources and policymaking powers—is the key to preventing the accumulation of power in the hands of an encroaching executive. They show how low-capacity legislatures face difficulties checking the executive through mechanisms such as discretion and oversight, and how presidents and governors unilaterally bypass such legislative adversaries to impose their will. When legislative capacity is high, however, the legislative branch can effectively stifle executives. Bolton and Thrower draw on a wealth of historical evidence on congressional capacity, oversight, discretion, and presidential unilateralism. They also examine thousands of gubernatorial executive orders, demonstrating how varying capacity in the states affects governors’ power. How the tools of information technology can support environmental sustainability by tackling problems that span broad scales of time, space, and complexity. Environmental issues often span long periods of time, far-flung areas, and labyrinthine layers of complexity. In Greening through IT, Bill Tomlinson investigates how the tools and techniques of information technology (IT) can help us tackle environmental problems at such vast scales. Tomlinson describes theoretical, technological, and social aspects of a growing interdisciplinary approach to sustainability, “Green IT,” offering both a human-centered framework for understanding Green IT systems and specific examples and case studies of Green IT in action. Tomlinson descrobes many efforts toward sustainability supported by IT—from fishers in India who maximized the sales potential of their catch by coordinating their activities with mobile phones to the installation of smart meters that optimize electricity use in California households—and offers three detailed studies of specific research projects that he and his colleagues have undertaken: EcoRaft, an interactive museum exhibit to help children learn principles of restoration ecology; Trackulous, a set of web-based tools with which people can chart their own environmental behavior; and GreenScanner, an online system that provides access to environmental-impact reports about consumer products. This book addresses the impact of EU law beyond its own borders, the use of law as a powerful instrument of EU external action, and some of the normative challenges this poses. The phenomenon of EU law operating beyond its borders, which may be termed its 'global reach', includes the extraterritorial application of EU law, territorial extension, and the so-called 'Brussels Effect' resulting from unilateral legislative and regulatory action, but also includes the impact of the EU's bilateral relationships, and its engagement with multilateral fora and the negotiation of international legal instruments.
