This series of short volumes, each devoted to a theme which is the subject of contemporary debate in archaeology, ranges from issues in theory and method to aspects of world archaeology. If 'all property is theft', then cultural property is nothing less than the theft of culture. The term 'cultural property' is widespread in the field of heritage management and is a particularly powerful concept in legal approaches. The term and the concept it represents are never discussed, however. The idea that material that comes to us from the past should be considered 'property' accordingly seems to be taken for granted by those charged with its care. Any debate that does take place is limited to comparing private with state ownership, often under the pretence that the latter represents a form of 'stewardship'. This radical work seeks to challenge the dominance of these limiting ideas by looking for alternatives. Taking as a starting-point the four different types of property relation generally recognised by lawyers and economists, the book explores the implications for cultural objects of different property regimes.In presenting an argument that the concept of 'property' is inappropriate for the heritage, the book challenges much that is taken for granted and undiscussed in the field of heritage management.

'Fernweh' is a collection of essays on archaeological heritage management issues dedicated to Professor dr. Willem J.H. Willems. Willem Willems (1950-2014) was one of the most prominent and influential Dutch archaeologists. He directed three national archaeological and heritage organizations, and played a major role in the development of both national and international heritage management systems. His professional passion was threefold: Roman archaeology, archaeological heritage management and international collaboration. This volume is a tribute to him, his passions and the provocative discussions he loved so much. It holds contributions by people who worked closely with him. The essays originate from various contexts across the globe; from governmental organizations to museums, from private sector companies to universities. Some are contemplative, others offer refreshing visions for the future. The essays contribute to contemporary debates in archaeological heritage management. This book undertakes a comparative study of the history and development of legislative and administrative systems in operation today for the protection of archaeological monuments. With the exception of Scandinavia and the United Kingdom, no country adopted a positive policy towards the protection and conservation of its archaeological and historical heritage until the twentieth century. Moreover, it was not until the middle of that century, under the threat of wholesale devastation from extensive schemes for social and economic development, that the accelerating disappearance of the sites and monuments of Antiquity became the object of intensive study and legislation. Since then systems of cultural resource management have developed throughout the world. A range of countries (from Europe, America, Asia and Africa) representing a diversity of political and ideological systems - capitalist, socialist and ex-colonial - have been selected as being broadly representative of the variety of these systems. The case studies have been written by distinguished archaeologists and provide critical evaluations of the objectives and shortcomings of these systems.
