C’est une lacune du droit international : rien aujourd'hui ne permet aux victimes d’injustices environnementales de réclamer l’application de leurs droits. Aucune sanction n’est prévue pour ceux qui menacent les Droits de la nature alors qu’il en va de la pérennité des conditions de la vie sur terre. Les Droits de la nature doivent accorder aux écosystèmes des droits à l’existence qui peuvent être revendiqués en justice. Ils proposent la reconnaissance du crime « d’écocide » pour les atteintes les plus graves contre l’environnement que les États et les entreprises non seulement permettent, mais parfois encouragent. Ces principes permettent de considérer la nature comme un sujet de droits plutôt que comme un objet. Cela remet en cause notre conception de la place de la nature par rapport à l’humanité. Car il ne saurait y avoir de Droits Humains et de droit des générations actuelles et futures à bénéficier d’un environnement sain et viable sans la reconnaissance des Droits de la nature et qu’émergent des nouveaux modèles de gouvernance mondiaux. Ce livre propose des évolutions du droit international pour que soit pris en compte la réalité des excès de notre monde industrialisé. Cela implique de faire du vivant un sujet de droit. C’est donc aussi une révolution philosophique du droit qui est proposée dans ce livre. Après la conquête des droits individuels, politiques et sociaux, à l’heure où de graves menaces pèsent sur la nature et l’humanité, il convient de concevoir et d’acquérir de nouveaux droits sécurisant la Terre et ses habitants. Ce livre a été écrit dans le cadre du troisième Tribunal international des droits de la Nature qui s’est tenu à Paris en décembre 2015, parallèlement à la COP21. Un livre nécessaire pour faire de la nature un sujet de droit à part entière. EXTRAIT Plus question de penser la liberté, la démocratie et le devenir des sociétés sans les flux de matière et d’énergie qui les trament et les relient à la vie de la Terre. Chaque projet de société suppose et génère son écologie, chaque économie-monde implique une écologie-monde, plus ou moins soutenable. Après avoir d’abord espéré une irénique réconciliation entre humains et non-humains, des penseurs comme Bruno Latour pensent la situation actuelle comme une véritable guerre des mondes. D’un côté les modernisateurs (humains, mais aussi machines et êtres vivants façonnés par le projet de domination de la nature) qui creusent toujours plus violemment la Terre et menacent de la consumer ; de l’autre les « terriens » (êtres non-humains et forces chtoniennes d’une irascible Gaïa, mais aussi d’innombrables collectifs humains en transition de l’arrachement vers la relation) acculés à la légitime défense contre les modernisateurs, à lutter pour que la majorité des ressources fossiles soit laissée sous le sol et travaillant à préserver et nourrir les vitalités régénératrices. This "Liber Amicorum" is published at the occasion of Judge Lucius Caflisch's retirement from a distinguished teaching career at the Graduate Institute of International Studies of Geneva, where he served as Professor of International Law for more than three decades, and where he has also held the position of Director. It was written by his colleagues and friends, from the European Court of Human Rights, from universities all around the world, from the Swiss Foreign Affairs Ministry and many other national and international institutions. The "Liber Amicorum Lucius Caflisch" covers different fields in which Judge Caflisch has excelled in his various capacities, as scholar, representative of Switzerland in international conferences, legal adviser of the Swiss Foreign Affairs Ministry, counsel, registrar, arbitrator and judge. This collective work is divided into three main sections. The first section examines questions concerning human rights and international humanitarian law. The second section is devoted to the international law of spaces, including matters regarding the law of the sea, international waterways, Antarctica, and boundary and territorial issues. The third section addresses issues related to the peaceful settlement of disputes, both generally and with regard to any particular means of settlement.
