Construction projects are beset with disputes. In 1960 around250 writs were issued relating to construction disputes. Within 30years this number increased five-fold, and in the 20 years sincethen the number of disputes has not fallen. Some disputes aresignificant, others are quite minor, but most could probably beavoided. Disputes originate in disagreements or conflict betweenindividuals, which if addressed early, can prevent escalation intosituations that are difficult, expensive and time consuming toresolve. Conflicts in Construction deals with all types ofconflict but concentrates on the conflicts that lead to disputes inconstruction projects. The book shows the reader how to avoid, manage and resolve conflicts before they become seriousdisputes. The first edition of Conflicts in Construction was readwidely and saved many individuals and companies from falling intointractable disputes. The second edition, fully updated, forms thebase content for the Hill/ Knowles seminar series on conflicts, delivered around the globe by the author, and will be an importantread for everyone employed in the construction industry.

Commerce is inherently complex and the sums of money involved can be astronomical, so it is no surprise that conflicts and disputes are all too common. There are numerous techniques designed to resolve these problems, and this book summarizes the most important of these, as well as alternative dispute resolution methods. The reader seeking a deeper understanding of these procedures will also find clear explanations of the principles and methods for conflict management, such as negotiation, risk management, mediation and conciliation. As well as outlining these different techniques, guidance on which approach is appropriate in common situations is also given, helping the reader apply what they have learned to the real world. The significance of cultural issues is explained, before the reader is presented with suggestions for how to take these into account. Throughout, the book is illustrated with case studies from examples as diverse as Mumbai's DabbaWalla, The First World War and Terminal 5 at London Heathrow. Written with undergraduate students in mind, this book also serves to give a neat and brief overview for professionals. Those studying or working in commerce generally, construction project management, construction management, and construction law will find this to be an invaluable book.

Tis handbook has three primary objectives : (?) to give the project managers gu- ance to avoid con?icts in project execution and to understand the procedures in case of legal proceedings, (?) to give lawyers the understanding of the technical problems in project management, and (?) to give students an introduction into the technical and legal aspects of managing big international projects. Te case studies and qu- tions at the end of each chapter are especially directed to the student and the young project managers, who try to enter the ever more complicated world of managing international projects. Tis book does not try to give legal advice, but it tries to help engineers and project managers how to thoroughly plan their project in order to avoid con?icts during execution. In this way it also helps lawyers to better understand their clients, when they have to defend them in con?icts regarding big international projects. Te authors’ many years of experience in managing international projects on one side and in assisting as experts and monitors of litigation on the other side have led them to write this book and thus to help other project managers avoid the mistakes that they themselves and other project managers have made in the past.

Reducing Construction Costs written by National Research Council and has been published by National Academies Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2007-11-09 with Technology & Engineering categories.

The National Academy of Construction (NAC) has determined that disputes, and their accompanying inefficiencies and costs, constitute a significant problem for the industry. In 2002, the NAC assessed the industry's progress in attacking this problem and determined that although the tools, techniques, and processes for preventing and efficiently resolving disputes are already in place, they are not being widely used. In 2003, the NAC helped to persuade the Center for Construction Industry Studies (CCIS) at the University of Texas and the Alfred P. Sloan Foundation to finance and conduct empirical research to develop accurate information about the relative transaction costs of various forms of dispute resolution. In 2004 the NAC teamed with the Federal Facilities Council (FFC) of the National Research Council to sponsor the "Government/Industry Forum on Reducing Construction Costs: Uses of Best Dispute Resolution Practices by Project Owners." The forum was held on September 23, 2004, at the National Academy of Sciences in Washington, D.C. Speakers and panelists at the forum addressed several topics. Reducing Construction Costs addresses topics such as the root causes of disputes and the impact of disputes on project costs and the economics of the construction industry. A second topic addressed was dispute resolution tools and techniques for preventing, managing, and resolving construction- related disputes. This report documents examples of successful uses of dispute resolution tools and techniques on some high-profile projects, and also provides ways to encourage greater use of dispute resolution tools throughout the industry. This report addresses steps that owners of construction projects (who have the greatest ability to influence how their projects are conducted) should take in order to make their projects more successful.
