Qu'est-ce qu'une chose ? La question du philosophe, le juriste se la pose. Il en est de toutes sortes. De la chose au droit sur la chose, puis plus largement aux biens, tels que les envisage le droit. Choses corporelles, mais aussi incorporelles, illustrent les relations les plus diverses de la matière et de l'esprit. Entre les hommes et les choses, il existe des liens juridiquement protégés. Manifestation la plus accusée de cette protection, distinct de la possession avec laquelle il entretient pourtant des rapports étroits, le droit de propriété est au cœur du droit des biens. De la relation qu'il exprime découle l'explication de la consistance et du rôle des patrimoines. La compréhension de la " propriété individuelle " passe par l'étude de l'étendue du droit de propriété : l'air, le sol, l'eau, les constructions, le voisinage... Elle tient compte des intérêts de la collectivité. Elle suppose la connaissance des modes d'acquisition et de perte de la propriété : par occupation, par convention, par possession, par prescription. Le droit des biens s'ordonne aussi autour d'autres formes de l'avoir. D'une part, les " propriétés collectives ", telles la propriété des personnes morales, l'indivision, la copropriété, spécialement celle des immeubles bâtis. D'autre part, la " propriété démembrée " : usufruit et nue-propriété, usage et habitation, servitudes. L'avoir est subordonné à l'être. Mais il lui est nécessaire.
