Cette thèse a pour objet de déterminer comment le droit antidiscriminatoire peut contribuer à améliorer l'insertion professionnelle des personnes handicapées. La première partie est consacrée à la conception juridique du traitement des personnes handicapées. Celle-ci se caractérise par son évolution. La première approche du traitement juridique des personnes handicapées est liée à une conception du handicap comme attribut de l'individu, appréciée à l'aune d'une conception biomédicale de la normalité. Le traitement juridique, fondé sur un traitement catégoriel, coïncide alors avec un mécanisme de protection par les techniques classiques de la solidarité, mais emporte aussi des effets de stigmatisation. Sous l'influence du droit international et du droit européen, un changement s'opère en faveur d'un traitement égalitaire. La conception du handicap devient sociale. Le handicap est désormais perçu comme la résultante d'une interaction entre la personne et son environnement. Une telle évolution a nécessairement des répercussions sur la façon de concevoir l'égalité pour les personnes handicapées. L'exigence d'égalité nécessite de s'intéresser au dispositif antidiscriminatoire en matière de handicap. Celui-ci présente une spécificité dont la légitimité est fondée sur la prise en compte du handicap comme facteur de différence et la pertinence de mettre en oeuvre un traitement différencié. La seconde partie est dédiée à l'étude des voies de réalisation de l'égalité qui empruntent les traits de deux instruments distincts. En premier lieu, l'aménagement raisonnable constitue une voie novatrice : la voie de l'édiction d'une norme antidiscriminatoire créant une obligation positive à la charge de l'employeur. Pour ne pas se contenter d'une étude des dispositifs législatifs internes — seule étude que le droit positif permet à l'heure actuelle — c'est une analyse de l'aménagement raisonnable à la lumière du droit canadien qui a été entreprise. Cette analyse vise à comprendre quelle peut être la portée de ce mécanisme en droit français. En second lieu, les actions positives constituent une autre voie de mise en oeuvre de l'exigence de non-discrimination. Dans le domaine du handicap, l'action positive se traduit principalement par une obligation d'emploi de travailleurs handicapés sous forme d'un quota à respecter. Elle revêt parfois une forme plus atypique par le biais de la conclusion d'accords collectifs, le dialogue social pouvant alors être considéré comme l'instrument d'une action publique négociée. Au-delà, cette étude permet d'observer une évolution majeure. Ce qui était considéré comme pathologique ne l'est plus. C'est le regard exterieur qui transforme la différence, la singularité en problème. Le handicap doit être résolument saisi dans une dynamique relationnelle.
