Insurance Directives deal with the applicable law to insurance contracts covering risks situated within the EU. They do not deal with the applicable law to reinsurance contracts and insurance contracts covering risks situated outside the EU. This should be ascertained by reference to the choice of laws provisions in the 1980 Rome Convention on the law applicable to contractual obligations. Detailed discussion of these rules is also provided, and proposals for reform suggested.

This comprehensive two-volume work is a collection of determinations from OPIC, the US governmental political risk insurance provider, in the form of its Memoranda of Determinations from 1966 through to 2010. An important part of international investment law and policy is the political risk insurance coverage provided to international investors by their home states and multilateral organizations such as the World Bank. These programs are of crucial importance to the growth of international investment flows and the development of international investment law. The insurance claim decisions and as a result this area of international law has received disproportionately little attention. Le droit des assurances est un droit omniprésent, extraordinaire mine de réflexions. Contrat spécial parmi les contrats nommés, le contrat d'assurance apporte à la théorie générale du contrat un terreau fécond. Parce qu'elle est étroitement liée à la responsabilité civile, l'assurance fournit l'explication de son développement et en canalise les effets. L'étude du contrat d'assurance autorise une autre vision de la relativité des conventions. En droit classique, le tiers est véritablement étranger au contrat. Sans que celui-ci soit tourné contre lui, il ne lui nuit ni ne lui profite. Le tiers est en position de neutralité. Tel n'est pas le cas dans le contrat d'assurance où la présence d'un tiers est fréquente, qui plus est prévue. C'est même souvent lui qui en sera le bénéficiaire comme dans l'assurance de responsabilité ou dans l'assurance-vie. La cohérence de ce droit se trouve, donc, dans le contrat d'assurance plus que dans les assurances. Or, ce droit spécial risque d'éclater par la multiplication infinie des assurances spéciales qui surgissent constamment au fil des textes voulus par le législateur d'une société redoutant le risque. Le parti pris dans cet ouvrage est inverse : tout ramener au droit ordinaire de l'assurance. Le spécial doit enrichir le général et non en altérer la dominante. C'est la raison pour laquelle le plan de cet ouvrage est celui du déroulement ordinaire du contrat d'assurance sous toutes ses variantes, sans distinguer un droit général de l'assurance, d'un côté, et un droit des assurances spéciales de l'autre : fondements de l'assurance, intermédiaires de l'assurance, risque, contrat, prime, sinistre, indemnisation, prescription biennale et litige.

It is widely acknowledged that insurance has a major impact on the operation of tort and contract law regimes in practice, yet there is little sustained analysis of their interaction. The majority of academic private lawyers have little knowledge of insurance law in its own right, and the amount of discussion directed to insurance in private law theory is disproportionately small in relation to its practical importance. Filling this substantial gap in the literature, this book explores the multiple influences of insurance in the law of obligations, and the nature and impact of insurance law as an inherent and significant aspect of private law. It combines conceptual and doctrinal analysis, informing the theoretical discussion of the nature of private law, including the role of judicial and public purpose, and the place of formalism and of contextualism in normative theories of private law. Arguing for the wider recognition of the multiple impacts of insurance, the book claims that recognition of the presence of insurance necessarily marks a departure from the two-party framework sometimes described as definitive of private law. The structured exploration and interpretation of the contemporary role of insurance in the law of obligations, and of its implications, illuminates this under-explored area of private law, and equips the reader for further enquiry and debate.
