Son importance tient surtout du fait qu’elle est, pour le dire avec le professeur Bernard-Raymond GUIMDO, une phase charnière qui voit s’affronter plusieurs intervenants que le Code des marchés publics camerounais qualifie de soumissionnaires. C’est dire qu’elle est considérée comme la porte d’entrée du grand empire opaque des marchés publics. Fort de ceci, nous avons choisi de nous plonger dans cet univers à la fois technique pour les uns et ambigu pour les autres. Nous n’entendons pas bien sûr traiter de l’ensemble de la question, mais il s’agit ici de présenter les règles et les principes cadres qui régissent les procédures et le contentieux de la passation des marchés publics au Cameroun. Les procédures, en échelonnant les différentes phases pratiques de chaque type de marché, les types de contrôle et les cas de violation de la réglementation, que les textes érigés par les pouvoirs publics camerounais ont consacrés ; Et le contentieux en développant l’aspect litigieux qui peut découler de ces phases de la passation des marchés, tout en insistant sur les moyens consacrés de règlement. C’est donc ces canaux que nous avons choisi d’emprunter pour répondre à notre problématique centrale : Quelles sont les règles qui encadrent les procédures et le contentieux de la passation des marchés publics au Cameroun? Espace géographique retenu pour notre travail, le Cameroun a depuis 2004 entrepris plusieurs réformes visant à améliorer son système de passation des marchés et cette dynamique se poursuit jusqu’à ce jour. C’est d’ailleurs le constat que nous faisons dans ce travail en balayant aussi le sujet de la passation des marchés publics par voie électronique, récemment consacré par un décret du premier ministre le 5 janvier 2018; toute chose qui montre comment ce pays d’Afrique centrale veut véritablement orienter ses politiques vers la tendance moderne actuelle qui impose de plus en plus son dictat dans la sphère économique mondiale: l’économie numérique. C’est dire que la place de choix qu’occupe la phase de passation dans les marchés publics au Cameroun aujourd’hui, semble toute aussi délicate que celle de la phase d’exécution et son bon déroulement pourrait d’ailleurs être perçu comme une condition sine qua non à une bonne exécution du marché.

The author offers an assessment of the practical application of the laws regulating constitutional institutions and how they impact on governance. To lay the groundwork for the analysis, the book examines the historical, constitutional and political context of governance in Cameroon, from independence and reunification in 1960–1961, through the adoption of the 1996 Constitution, to more recent events including the current Anglophone crisis. Offering novel insights on new institutions such as the Senate and the Constitutional Council and their contribution to the democratic advancement of Cameroon, the book also provides the first critical assessment of the legislative provisions carving out a special autonomy status for the two Anglophone regions of Cameroon and considers how far these provisions go to resolve the Anglophone Problem.
