Recent case-law and legislation in European company and insolvency law have significantly furthered the integration of European business regulation. In particular, the case-law of the European Court of Justice and the introduction of the EU Insolvency Regulation have provided the stimulus for current reforms in various jurisdictions in the fields of insolvency and financial law. Le traitement judiciaire des entreprises en difficulté est un contentieux institutionnalisé qui poursuit une finalité objective imposée par le législateur. La prééminence du traitement de l'entreprise et l'évolution de la fonction du juge, qui n'intervient pas pour trancher à proprement parler un litige mais exercer une magistrature économique, confèrent à ce contentieux un régime procédural particulier par rapport au droit judiciaire privé. Pour assurer l'efficacité du traitement de l'entreprise, le législateur a institué un bloc de compétence en matière de "faillite", amenagé la sanction des règles de compétence et généralisé l'exécution provisoire de plein droit. La spécificité du traitement de l'entreprise apparaît aussi par la réorganisation des principes du procès : les principes accusatoire et dispositif, manifestant la maîtrise des parties sur le déroulement et la matière du procès, sont inadaptés au traitement de l'entreprise caractérisé par une immutabilité renforcée nécessaire à la préservation de sa finalité. Par ailleurs la prééminence de l'entreprise s'est manifestée par un recul du droit d'action des créanciers et par un aménagement restrictif des voies de recours tempéré cependant par l'explosion des recours-nullité. La spécificité du traitement judiciaire de l'entreprise en difficulté a aussi modifié les concepts de la procédure civile. L'émergence de la notion de "partie nécessaire", la prétendue autorité absolue des décisions relatives au traitement de l'entreprise, l'inadaptation de la notion de succombance sont très révélatrices de l'influence des procédures collectives sur le droit judiciaire privé. La richesse et la complexité des rapports entre les procédures collectives et le droit judiciaire privé tiennent au fait que le législateur n'a jamais institué "une procédure collective" au sens procédural qui, dotée d'une structure particulière, se distinguerait de la procédure civile de droit commun.
