Cet ouvrage ne prétend pas à l'exhaustivité, sûrement impossible à atteindre. Il reprend les thèmes traités dans le " Droit et administration de l'environnement " publié dans cette même collection, afin d'éclairer par les approches internationale et européenne - sans les séparer dans des développements distincts, évidemment - la présentation du système français de protection et de gestion de l'environnement qui y est faite. C'est dans cet esprit que seront évoqués d'abord les sources et les principes du droit international et du droit européen de l'environnement, puis les différentes branches de ces droits : le droit de la protection de la nature (protection et gestion des espèces et des espaces, et gestion des milieux spécifiques), le droit des pollutions (régulation des rejets dans l'eau et l'air) et le droit des nuisances (régulation des nuisances sonores et gestion des déchets). Au-delà de l'examen, dans cet ordre devenu classique, du droit de l'environnement stricto sensu, il convient de plus d'examiner de quelle manière les autres politiques intègrent, tentent d'intégrer ou font mine d'intégrer les principes du droit de l'environnement pour concrétiser juridiquement, si faire se peut, l'objectif de développement durable.

The participation of the European Community and the Member States in the international climate change regimes is a complex issue. In the case of the Kyoto Protocol, this is rendered more complicated by the fact that for the purposes of Article 4 of the Kyoto Protocol, the membership of the European Community and Member States is frozen at a particular point in time. The result of this is that under International Law the European Community and a part of the Member States (EU15) have agreed to jointly fulfil some of those obligations whereas under Community Law all Member States share a certain degree of responsibility to meet the obligations created by the Kyoto Protocol. This book examines 'The Espoo Convention on Environmental Impact Assessment in a Transboundary Context', which celebrates the twentieth anniversary of its adoption in 2011, and its 'Kiev Protocol on Strategic Environmental Assessment' which came into force in July 2010. In addition to contributing to international environmental law, the Convention has prompted significant changes to European environmental law. The chapters in this collection explain the role of transboundary environmental impact assessment in international and European law, and explore the relationship between international and European law in the context of potential application of the Convention.
