In November 1979 the US government froze over $14 billion of Iranian assets in response to the Iranian revolution and the seizure of US hostages. Since then, freezing sovereign assets has become an increasingly frequent and highly effective economic sanction. It has been used against Nicaragua, Libya, Panama, Kuwait and Iraq. This book is a comprehensive study of asset-freezing as an economic sanction and a political weapon. It analyses the international financial, legal and political implications of asset-freezing. It concentrates on the freeze against Iran to discover the initial motivations and mechanisms of asset-freezing. The book examines its political, economic and legal basis: beginning with the US International Emergency Economic Powers Act of 1977; through the legal implications of the extraterritorial application of the freeze order and the litigation in European courts; and ending with an examination of the political agreement that resolved the Iranian crisis in 1981. It shows how this agreement superseded litigation in the US courts which would have produced judgments far more favourable to Iran. Finally, there is a comparative analysis of freezes after the Iranian case and suggestions for the ways in which countries vulnerable to asset-freezing can protect themselves against this unilateral instrument of hegemony by a major financial power.

The Iran-United States Claims Tribunal is arguably the most significant arbitral institution of the twentieth century. Although the completion of its last few cases could take a long time, the Tribunal's impressive work must be made available now as a guide to the resolution of ongoing disputes and for future tribunals. The Tribunal has, by this point, disposed of well over 98 percent of its caseload. Little more remains for its participants to learn, but the Tribunal shows no signs of fading away. Both of the two States Parties, for different reasons, see greater advantage in the Tribunal's prolongation than in its elimination. The authors have succeeded in dealing with all of the most deserving Tribunal subjects. Moreover, their intimate involvement in and knowledge of the Tribunal ensure that their book is a fascinating, important, and indispensable contribution to the literature of International Law. This is a definitive book on a monumental event in the law and in history at the close of a century. "The Iran-United States Claims Tribunal" was awarded the ASIL Certificate of Merit.

International trade policy is facing a cross-roads. This is creating uncertainty, impairing world economic growth. Unless a policy of more open markets is pursued, protectionism may well turn into a self-perpetuating and cumulative process. This is why the 1986 Kiel Conference was devoted to Free Trade in the World Economy: Towards an Opening of Markets. We felt that such a conference would help to stimulate policy discussion preceding the Uruguay Round under the auspices of the GATT and the moves within the European Community towards completing a common internal market by 1992.

Rationality And Legality Of Non Market Economy Treatment In Antidumping Law written by Shao Long and has been published by Springer Nature this book supported file pdf, txt, epub, kindle and other format this book has been release on 2024-01-03 with Law categories.

This book serves as a comprehensive study of and provides rich insight into non-market economy treatment, including its past, present, and estimated future practices and implications. It explores the introduction of the market and non-market economy dichotomy into international trade law. It traces the origin and development of non-market economy treatment against changing international economic and political background. The book examines this treatment in light of the rationale underlying anti-dumping, reflecting its alleged significance of ensuring fair trade. It in particular investigates the varied non-market economy treatment practices responding concerns of China’s rising as a large state-led economy, analyzing the deviation of NME treatment into an all-in trade tool. The book argues against preconceived bias and unilateral protectionism. It highlights the universal existence of government involvement in the market and proposes objective assessment of its impact on fair trade. Final proposition of the book is depoliticizing trade, reforming comprehensively international trade rules to carefully calibrate different values, including promoting fairness and enhancing global social welfare. It envisages a multi-dimension overhaul of international trade rules to rebalance trade interests, rather than roughly labeling an economy to confer different treatment, the practices of which lead to separation and chaos. The book is of particular relevance and interest to economies-in-transition, and among policy makers, academicians and legal practitioners engaged in trade remedies and trade rules reconstruction.
