=========== Yves Poullet has not merely served but excelled in all functions of the University world. Whether as professor, researcher, director of a research centre or as dean and rector, he has left a lasting impression in the minds of generations of students, researchers, colleagues and peers. He is a preeminent expert on the law of Internet and Information and Communications Technologies who, already in 1979, pioneered one of the first European research centres in the field. This volume is a tribute to Yves Poullet from colleagues, friends, former PhD researchers, offering their reflections on the reciprocal influence of law and technology. These contributions highlight both the range of expertise and the extent of the European and international networks he has nourished. They address the three main research axes Yves Poullet has developed through the years: law, norms and freedoms. The authors of this volume pay homage to a mentor, a friend, but above all to an exceptional researcher who has sown countless seeds in the field, enabling a luxurious landscape to grow and become a source of inspiration for many scholars. This is the heritage of a genuine thinker, a real academic.

The French law of international arbitration has a beginning (1963) and a culminating point (2007), but fortunately it does not have an ending. Indeed, it does not cease to evolve, to improve, to perfect itself. Thus it invites one to carefully observe it. But before undertaking this careful observation by annually identifying the most important decisions, as this collection has been doing since 2008, it is important to recall the origins of French law on international arbitration, how it was built, and in so doing, predict where it is heading. Looking into the past to anticipate the future, that is also the interest of a book like the present one. This selection, necessarily subjective, is also shaped by the advantages that a retrospective look offers. The benefit of hindsight allows one to confidently distinguish between the decisions that deserve mention and those which did not make it into history. Only the former are printed in the following pages, but all of such decisions are included. Conversely, all decisions from 2008 onwards will be methodically published in the annual reports of this collection, of which two editions have already been released for the years 2008 and 2009. Aimed for practitioners and academics alike, the knowledge of French case law is indispensable to understanding international arbitration and its important influence around the world.

The Cambridge Handbook Of Smart Contracts Blockchain Technology And Digital Platforms written by Larry A. DiMatteo and has been published by Cambridge University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2019-10-31 with Law categories.

The product of a unique collaboration between academic scholars, legal practitioners, and technology experts, this Handbook is the first of its kind to analyze the ongoing evolution of smart contracts, based upon blockchain technology, from the perspective of existing legal frameworks - namely, contract law. The book's coverage ranges across many areas of smart contracts and electronic or digital platforms to illuminate the impact of new, and often disruptive, technologies on the law. With a mix of scholarly commentary and practical application, chapter authors provide expert insights on the core issues involving the use of smart contracts, concluding that smart contracts cannot supplant contract law and the courts, but leaving open the question of whether there is a need for specialized regulations to prevent abuse. This book should be read by anyone interested in the disruptive effect of new technologies on the law generally, and contract law in particular.

The Emergence Of Personal Data Protection As A Fundamental Right Of The Eu written by Gloria González Fuster and has been published by Springer Science & Business this book supported file pdf, txt, epub, kindle and other format this book has been release on 2014-04-28 with Law categories.

This book explores the coming into being in European Union (EU) law of the fundamental right to personal data protection. Approaching legal evolution through the lens of law as text, it unearths the steps that led to the emergence of this new right. It throws light on the right’s significance, and reveals the intricacies of its relationship with privacy. The right to personal data protection is now officially recognised as an EU fundamental right. As such, it is expected to play a critical role in the future European personal data protection legal landscape, seemingly displacing the right to privacy. This volume is based on the premise that an accurate understanding of the right’s emergence is crucial to ensure its correct interpretation and development. Key questions addressed include: How did the new right surface in EU law? How could the EU Charter of Fundamental Rights claim to render ‘more visible’ an invisible right? And how did EU law allow for the creation of a new right while ensuring consistency with existing legal instruments and case law? The book first investigates the roots of personal data protection, studying the redefinition of privacy in the United States in the 1960s, as well as pioneering developments in European countries and in international organisations. It then analyses the EU’s involvement since the 1970s up to the introduction of legislative proposals in 2012. It grants particular attention to changes triggered in law by language and, specifically, by the coexistence of languages and legal systems that determine meaning in EU law. Embracing simultaneously EU law’s multilingualism and the challenging notion of the untranslatability of words, this work opens up an inspiring way of understanding legal change. This book will appeal to legal scholars, policy makers, legal practitioners, privacy and personal data protection activists, and philosophers of law, as well as, more generally, anyone interested in how law works.

Governance By Numbers written by Alain Supiot and has been published by Hart Publishing this book supported file pdf, txt, epub, kindle and other format this book has been release on 2020-03-19 with Law categories.

The West's cherished dream of social harmony by numbers is today disrupting all our familiar legal frameworks - the state, democracy and law itself. Its scientistic vision shaped both Taylorism and Soviet Planning, and today, with 'globalisation', it is flourishing in the form of governance by numbers. Shunning the goal of governing by just laws, and empowered by the information and communication technologies, governance champions a new normative ideal of attaining measurable objectives. Programmes supplant legislation, and governance displaces government. However, management by objectives revives forms of law typical of economic vassalage. When a person is no longer protected by a law applying equally to all, the only solution is to pledge allegiance to someone stronger than oneself. Rule by law had already secured the principle of impersonal power, but in taking this principle to extremes, governance by numbers has paradoxically spawned a world ruled by ties of allegiance.
