This collection brings together some of the most influential sociologists of law to confront the challenges of current transnational constitutionalism. Pour une renouvellement éspitémologique Sans répit, nous assistons aux collusions fatales entre certaines façons de faire de la science et les industries ou les États soumis aux règles d’airain du profit. Cette science dévoyée, abandonnant l’idée d’une exploration du monde pour l’honneur de la connaissance, tend à remplacer dans les têtes comme dans les instances de décision une science éthiquement responsable. Cette situation ne peut que s’aggraver, si l’on n’y prend pas garde et si l’on ne se munit pas d’outils idoines pour y faire face. Issues de la science fondamentale ou dûment inventées pour des buts précis, les techniques les plus bouleversantes, anthropologiquement parlant, sont déjà présentes ou susceptibles d’être mises au point dans quelques années. Ces techniques sont là tandis que les moyens d’en comprendre tous les tenants et aboutissements et de les circonscrire sont sous-développés. L’ouvrage de Léo Coutellec se veut une contribution pour repenser les rapports entre sciences et éthiques, et ainsi avancer vers ce qu’il appelle une « démocratie épistémique ». En démontrant l’insoutenabilité d’une science contre l’Homme, la visée est de réunir-sans-unifier ce qui, dans la science, est de l’ordre de l’épistémique, du technique et de l’éthique. Pour ce faire, l’auteur procède par étapes, travaillant préalablement et en profondeur sur deux espaces : épistémologique et éthique. Il ne saurait être question de la fin de l’épistémologie mais de la nécessité de son renouvellement. Celui-ci passera, et il s’agit là de la thèse principale de cet ouvrage, par de nouveaux rapports avec l’éthique. L’auteur donne à cette thèse le nom d’« intégrité épistémique et éthique des sciences ». En épistémologie, il s’agit d’identifier et de reconnaître la matérialité plurielle constitutive des sciences. Avec l’hypothèse d’un « pluralisme épistémique ordonné et cohérent », Léo Coutellec démontre que la pensée épistémologique associée aux sciences et aux techniques contemporaines ne se résume pas à une opposition entre positivisme et relativisme. L’ouvrage de Léo Coutellec se veut une contribution pour repenser les rapports entre sciences et éthiques, et ainsi avancer vers ce qu’il appelle une « démocratie épistémique » EXTRAIT De façon générale, l’éthique évolutionniste cherche à introduire le point de vue de l’évolution dans les débats sur l’origine et la justification morale. Elle s’inspire de la biologie évolutive, de la théorie des jeux, de la neurobiologie et d’autres domaines scientifiques pour aborder des questions traitées en philosophie morale. Ainsi, selon les partisans de l’éthique évolutionniste, « les valeurs et normes morales peuvent trouver un ancrage dans les données factuelles ; elles dépendraient directement de la manière dont la nature nous a façonnés ». Nos jugements ou comportements moraux seraient donc le produit de la sélection naturelle, inscrits dans une « nature humaine », un ensemble de propriétés biologiques de l’être humain. La morale est alors considérée soit comme une propriété intrinsèque à la nature humaine, soit comme une fonction biologique, soit comme un paramètre adaptatif. À PROPOS DE L'AUTEUR Léo Coutellec est chercheur et enseignant en philosophie des sciences et des techniques à l’Insa (Institut national des sciences appliquées) de Lyon et à la faculté de philosophie de Lyon 3. Il travaille actuellement au renouvellement de la pensée épistémologique dans ses liens avec l’éthique. Ses recherches visent à définir les conditions d’une démocratie épistémique et s’articulent autour de la question suivante : sous quelles conditions l’intégrité des sciences peut-elle être tout autant épistémique qu’éthique ?
