D’application locale, européenne ou internationale, les normes du travail sont le reflet d’une réalité économique, d’une expression juridique, d’une volonté politique voire d’une démarche idéologique. Le travail est la manifestation d’un agir humain. Il conduit à un engagement de la personne dans ce qu’elle est, et conduit à la relation à l’autre, caractéristique de la nature humaine : le travail devient alors un lieu de coopération et de collaboration. L’article 23 de la Déclaration universelle des droits de l’homme trouve notamment sa source dans l’affirmation selon laquelle le travail est un droit et constitue un des éléments fondamentaux de la personne humaine, comme de la société. À ce titre, le travail implique des droits, formalisés par des normes. Le travail se doit, en effet, d’être l’expression de la dignité essentielle de tout homme et de toute femme. Envisagées comme un modèle, une référence pour évaluer les situations et apprécier leur conformité, ou appréhendées à travers leurs fonctions, les normes du travail obéissent à une éthique, règlent les conduites et fixent des limites. Elles s’illustrent par leur capacité à assimiler les multiples influences exercées par les diverses personnes intéressées et, par leurs effets, elles transforment les rapports entre les personnes. Aussi, sont-elles appelées à évoluer en raison des faits, du temps, du territoire et du système de valeurs retenu par la société. La présente publication contribue à l’étude des normes du travail au prisme de la personne et à l’évaluation de celles-ci à l’aune de l’épanouissement de l’être.
