Dans le cadre de la mise en commun de leurs expériences respectives, nos revues ont mené une enquête conjointe sur le thème : " Regards contemporains sur l'anthropologie du Droit ", permettant de réunir des témoignages personnels exprimant une définition de l'anthropologie du Droit, des démarches, des expériences, des champs de recherche, mais aussi des points de vue critiques, des souhaits et des perspectives. Ont contribué 49 personnes, juristes, anthropologues, sociologues, magistrats, universitaires, consultants, et beaucoup de jeunes docteurs et doctorants qui, chacun à leur façon, ont tenté de montrer l'intérêt de l'impossible mariage entre la carpe et le lapin, entre l'anthropologie et le droit. Les questionnements et les expériences qui sont présentés montrent que l'anthropologie du Droit est une spécialité interdisciplinaire, scientifique et d'actualité, même lorsqu'elle s'intéresse au passé. Impertinente à l'égard du droit positif, elle oppose aux certitudes des codes le doute scientifique et la réalité complexe des " terrains " juridiques et ethnographiques. Les textes que l'on découvre ici illustrent une image de la recherche francophone qui allie pratique du terrain et analyses théoriques, et qui est avide d'informations et de problématiques venant de tous les horizons culturels, non exclusivement francophones. C'est à une grande ouverture sur le monde et sur les autres que le lecteur est convié.

This volume offers a new theoretical approach to the analysis of the law/revenge binary, and attempts to dismantle the common idea of revenge as lacking any legal, moral or rational dimension. In contrast, the book puts forward a model of a complex system of justice—which it terms 'vindicatory'—wherein vendetta constitutes an authorized action, the core of which does not (just) lie in vengeance but also in settlement procedures for peace—or 'composition.' The first part of the book ("Vindicatory Justice: Conceptual Analyses and Forerunners") seeks to identify the nature of vindicatory justice and to shed light on the structure of so-called vindicatory systems. In turn, the second part ("Mapping Vindicatory Justice") illustrates, using examples gathered from a range of sociolegal contexts, the dynamic relationship between composition and authorized revenge in vindicatory systems. Taken as a whole, the volume shows that applying a longue durée historical perspective to the study of revenge systems allows us to clearly recognize composition and authorized revenge as features of the same legal system, even though one of them may seem predominant (or more eye-catching) than the other in certain cultural settings.

Telling in current biblical postcolonial discourse that draws insights from the works of Aime Cesaire, Frantz Fanon, and postcolonial theorists is the missing contribution of Leopold Sedar Senghor, the architect of Negritude. If mentioned at all, Senghor is often read through conclusions drawn by his critics or dismissed altogether as irrelevant to postcolonialism. Restored to its rightful place, Senghorian Negritude is a postcolonial lens for reading Scripture and other faith traditions with a view to reposition, conscientize, liberate, and rehabilitate the conquered, and enable them to reclaim their faith traditions and practices that once directed a mutual relationship between God, human, and nature--a delicate symbiosis before the French colonial advent in West Africa. A keen eye for cross-cultural analysis and contextualization enriched this volume with an intriguing reading of scripture, Ancient Near Eastern and Greco-Roman texts in conversation with other faith traditions, particularly Senegalese Diola Religion. As a Poetics of Postcolonial Biblical Criticism, Negritude is an optic through which people of faith may look around themselves, critically reread their sacred texts, reassess their vocation, and practice mutuality with God and nature on the heels of chilling climate change. Enshrined in this innovative argument is a call for introspection and challenge for people of faith to assume their vocation--human participatory agency.
