L'étude des transformations du droit administratif par le droit de l'Union européenne met en évidence un droit spécifique, le droit administratif européen. Fondé sur un système de sources spécifique dont procèdent des règles originales, il s'appuie sur des raisonnements et des méthodes du juge renouvelés. Le droit administratif européen induit alors une transformation de la légalité administrative et de son contrôle. Ainsi européanisé, le droit administratif français est d'abord un droit composite, alimenté de traditions juridiques diverses et formé de règles disparates ; il constitue ensuite un droit intégré, dès lors que l'exercice de l'action administrative et la protection de l'administré exigent, au sein d'un espace juridique ouvert, une coopération à la fois administrative et juridictionnelle. Néanmoins, ces transformations n'altèrent pas l'essence même du droit administratif français. D'une part, son existence et sa spécificité se révèlent indispensables au fonctionnement du système juridique européen. D'autre part, l'intégration des règles et notions de l'Union européenne passe par une appropriation de celles-ci par les instances nationales. Le droit administratif français adopte les solutions européennes mais conserve son originalité. Elle réside dans le recours à des raisonnements internes permettant d'atteindre une solution compatible avec les exigences d'effectivité du droit de l'Union. Ceci explique le constat d'évolution et de permanence du droit administratif.

Organized by the REHSEIS group (Research on Epistemology and History of Exact Sciences and Scientific Institutions) of CNRS (National Center for Scientific Research), the colloquium was held from 3 to 6 April 1990 in the UNESCO building in Paris. This colloquium was an idea of Professor Roshdi Rashed who initiated this field of studies in France some years ago, and proposed "Sciences and Empires" as one of the main research programmes for the The project to organize such a colloquium was a bit REHSEIS group. of a gamble. Its subject, reflected in the title "Sciences and Empires", is not a currently-accepted sub-discipline of the history of science; rather, it refers to a set of questions which found autonomy only recently. The terminology was strongly debated by the participants and, as is frequently suggested in this book, awaits fuller clarification.

Unlike many other countries, the United States has few constitutional guarantees of social welfare rights such as income, housing, or healthcare. In part this is because many Americans believe that the courts cannot possibly enforce such guarantees. However, recent innovations in constitutional design in other countries suggest that such rights can be judicially enforced--not by increasing the power of the courts but by decreasing it. In Weak Courts, Strong Rights, Mark Tushnet uses a comparative legal perspective to show how creating weaker forms of judicial review may actually allow for stronger social welfare rights under American constitutional law. Under "strong-form" judicial review, as in the United States, judicial interpretations of the constitution are binding on other branches of government. In contrast, "weak-form" review allows the legislature and executive to reject constitutional rulings by the judiciary--as long as they do so publicly. Tushnet describes how weak-form review works in Great Britain and Canada and discusses the extent to which legislatures can be expected to enforce constitutional norms on their own. With that background, he turns to social welfare rights, explaining the connection between the "state action" or "horizontal effect" doctrine and the enforcement of social welfare rights. Tushnet then draws together the analysis of weak-form review and that of social welfare rights, explaining how weak-form review could be used to enforce those rights. He demonstrates that there is a clear judicial path--not an insurmountable judicial hurdle--to better enforcement of constitutional social welfare rights.
