Civil libertarians characterize prostitution as a "victimless crime," and argue that it ought to be legalized. Feminist critics counter that prostitution is not victimless, since it harms the people who do it. Civil libertarians respond that most women freely choose to do this work, and that it is paternalistic for the government to limit a person's liberty for her own good. In this book Peter de Marneffe argues that although most prostitution is voluntary, paternalistic prostitution laws in some form are nonetheless morally justifiable. If prostitution is commonly harmful in the way that feminist critics maintain, then this argument for prostitution laws is not objectionably moralistic and some prostitution laws violate no one's rights. Paternalistic prostitution laws in some form are therefore consistent with the fundamental principles of contemporary liberalism.

Since the 1960s the term “sexual revolution” described a cultural change in the western society towards a more liberal view of sexuality, monogamy and sexual relationships. Reasons for that are on the one hand the availability of new methods of birth-control like “The Pill” and the lack of fear of sexual diseases in the 1960s but on the other hand also a change of thoughts and believes which came up through the students movement of 1968 and its more promiscuous and hedonistic way of live (“Sex, Drugs & Rock'n Roll”), which still influences our sexual believes today. To understand the consequences of this development I want to explain the term “sexualization of society”, which describes the constant (or growing) presence of sexuality in public, in social perception and consciousness of the people. It also refers to the focus or emphasis on sexuality within a broader context and viewing an object under the sexual point of view or in terms of sexuality. I want to analyze if a sexualization of society as an example in the case of “mainstreaming of pornography” really has taken place and in what way this is reflected in pornography and prostitution. Therefore I will also consider the changes in the public opinion towards pornography and I will compare it to prostitution and its role in our society.

In the mid-nineteenth century many parts of England and Wales were still subjected to a system of regulated prostitution which, by identifying and detaining for treatment infected prostitutes, aimed to protect members of the armed forces (94 per cent of whom were forbidden to marry) from venereal diseases. The coercive nature of the Contagious Diseases Acts and the double standard which allowed the continuance of prostitution on the ground that the prostitute 'herself the supreme type of vice, she is ultimately the most efficient guardian of virtue', aroused the ire of many reformers, not only women’s rights campaigners. Paul McHugh analyses the social composition of the different repeal and reform movements – the liberal reformists, the passionate struggle of the charismatic Josephine Butler, the Tory reformers whose achievement was in the improvement of preventative medicine, and finally the Social Purity movement of the 1880s which favoured a coercive approach. This is a fascinating study of ideals and principles in action, of pressure-group strategy, and of individual leaders in the repeal movement’s sixteen year progress to victory. The book was originally publised in 1980.

This edited volume focuses on charting the rise of neo-abolitionism and offering a critique of the idea, its logics and consequences. A model of state policy which aims to abolish prostitution through legislation, Neo-abolitionism criminalises the buyer of sex but not the seller. It is currently law in Sweden and other Nordic states and dominates the framing of policy debates in many other Western liberal contexts. Pressure for adoption of this policy has come from radical feminists who understand prostitution and sex trafficking as a form of violence against women. This volume argues that this convergence between radical feminism and state’s interests arises from the emergence of, on the one hand, ‘governance feminism’ which seeks to have its ideals implemented through ‘top-down sovereigntist means’, and on the other hand, state’s interests in legitimising stricter border controls and law enforcement responses in relation to transnational organised criminality, ‘illegal’ migration, and security. Based around a series of country case studies each chapter will explore the politics surrounding the emergence of neo-abolitionism and its trajectory through those polities, whether the paradigm has been adopted, rejected or is still under debate. This book is a defense of political liberalism as a feminist liberalism. The first half of the book develops and defends a novel interpretation of political liberalism. It is argued that political liberals should accept a restrictive account of public reason and that political liberals' account of public justification is superior to the leading alternative, the convergence account of public justification. The view is defended from the charge that such a restrictive account of public reason will unduly threaten or undermine the integrity of some religiously oriented citizens and an account of when political liberals can recognize exemptions, including religious exemptions, from generally applicable laws is offered. In the second half of the book, it is argued that political liberalism's core commitments restrict all reasonable conceptions of justice to those that secure genuine, substantive equality for women and other marginalized groups. Here it is demonstrated how public reason arguments can be used to support law and policy needed to address historical sites of women's subordination in order to advance equality; prostitution, the gendered division of labor and marriage, in particular, are considered.
