Who is a child’s legal mother? Must a child have exactly one mother, can it have two or three, or can it have two fathers, but no mother? Or has the concept of motherhood become obsolete and should we just talk of parenthood in a gender neutral way? Questions such as these would have appeared esoteric only a few decades ago, but as a result of new social developments (such as frequent family reconstitutions, gay and lesbian emancipation or surrogacy) and of technological innovations (such as egg and embryo donations) they have become issues in a vehement debate. The interdisciplinary contributions to this book focus on the legal definition of motherhood, on the way in which legal conceptions structure the social discourse on motherhood (and vice versa), and on the influence of legal rules on power relations between mothers, fathers, children and the state. Among the issues addressed are - the challenges to our understanding of the legal regulation of motherhood by developments in reproductive medicine; - the challenges to our understanding of the legal regulation of motherhood by parental constellations deviating from the mother-father-model (single motherhood by choice, same-gender parenthood, multiple parenthood); - the exercise of parental rights in case of parental separation and the impact of legal rules on the bargaining positions of mothers and fathers.

Das Thema Familie wird heute immer häufiger zum Mittelpunkt politischer und medialer Debatten. Die bürgerliche Kleinfamilie, die für Deutschland typische gewesen zu sein scheint, ist immer seltener vertreten. Geburtenrückgang, Individualisierung der Gesellschaft, die Rolle der Frau – das und vieles mehr sorgen dafür, dass die "Klischee-Familie" Vater-Mutter-Kind langsam aber sicher verdrängt und durch andere Formen ersetzt wird. Auch in der Familiensoziologie wurde ein Wandel festgestellt. So definiert der Soziologe Hoffmann-Nowotny (1934-2004) den Begriff "Familie" wie folgt: Familie seien "Sozialformen eigener Art, die primär auf die Gestaltung der sozialen Beziehungen zwischen Eltern und Kindern angelegt sind, die als solche sozial anerkannt werden. Es bestehen Wechselwirkungen zwischen Familie und Gesellschaft." Diese Definition bezieht nicht nur das Ideal der bürgerlichen Kleinfamilie, sondern auch neue Familienformen mit ein, wie z.B. Alleinerziehende nichteheliche Lebensgemeinschaften oder homosexuelle Partnerschaften mit Kindern, da es um die Beziehung zwischen Eltern und Kind geht und die Lebensart der Eltern dabei keine Rolle spielt. In der Gesellschaft kann eine zunehmende Akzeptanz neuer Familienformen beobachtet werden, die vor fünfzig Jahren noch verpönt waren. Das wirkt sich auch auf die Familienpolitik aus. Kaum eine andere politische Kategorie erlebt so viele Reformen wie die Familienpolitik. So wurde bspw. 1972 die rechtliche Diskriminierung nichtehelich geborener Kinder und ihrer Mütter verboten. Auch 2001 gab es ein neues wichtiges Gesetz, das für viel Aufruhe gesorgt hatte: die Einführung des Gesetzes über eingetragene Lebenspartnerschaften gibt gleichgeschlechtlichen Paaren die Möglichkeit, ihrer Beziehung einen rechtlichen Rahmen zu geben, die dann in elementaren Punkten einer Ehe gleichgestellt ist.
