The great civilizations of the world are very different from one another, indeed more strangely different the closer they come in economic, social, and cultural interaction. Yet each claims to be a normative way of being human. At the very minimum human achievement requires competence in the conventions of one's own civilization. To be human is to participate in a conventional culture, and the normatively human conventional cultures are different. Here is the "clash of civilizations": Without commitment to some conventions of civilized humanity, no one can be human; yet the conventions are different, perhaps even opposed. Two problems bring philosophy to the refiner's fire. How can we conceive of human culture across the differences of civilized cultures? This is a problem about the nature of theory itself. It calls for a new theory of theorizing that at once provides synoptic understanding and recognized differences and incommensurabilities. Many postmodern critics have thundered against theories that oppress by the value-laden bias of their own forms, and by the interest guiding their forms. Neville provides a theory of theories that responds to these challenges and addresses the problem of theorizing across different cultures. The other problem is how to exercise practical reason across cultures expressive of different civilizations. How can human beings be responsible in a world where all values seem culture-bound and the obvious solution seems to be moral relativism that trivializes responsibility? Neville presents a theory of practical reason oriented to objective norms determined cross-culturally and based on a Confucian sense of the ritual character of the most important levels of moral life. This book completes Neville's series, Axiology of Thinking, a trilogy of systematically related studies of valuation in four kinds of thinking: imagination, interpretation, theorizing, and the pursuit of responsibility. Reconstruction of Thinking and Recovery of the Measure, both published by SUNY Press, are companion volumes.

International law has long been dominated by the State. But it has become apparent that this bias is unrealistic and untenable in the contemporary world as the rise of the notion of common goods challenges this dominance. These common goods – typically values (like human rights, rule of law, etc) or common domains (the environment, cultural heritage, space, etc) – speak to an emergent international community beyond the society of States and the attendant rights and obligations of non-State actors. This book details how three key areas of international law – human rights, culture and the environment – are pushing the boundaries in this field. Each category is of current and ongoing significance in legal and public discourse, as illustrated by the Syrian conflict (human rights and international humanitarian law), the destruction of mausoleums and manuscripts in Mali (cultural heritage), and the Deepwater Horizon oil spill (the environment). Each exemplifies the need to move beyond a State-focused idea of international law. This timely volume explores how the idea of common goods, in which rights and obligations extend to individuals, groups and the international community, offers one such avenue and reflects on its transformative impact on international law.

Cultural diversity, as expressed for instance in different normative orders or legal cultures, poses both a practical and a theoretical challenge to the idea of universal human rights. In the present volume, the authors seek to address and contain this challenge with a view to the changing nature of the global society. While 'culture' is sometimes signposted as an obstacle to human rights on the ground, this volume suggests that in so far as the global 'culture of human rights' is primarily seen as a formal and institutional order based on a particular view of equal human worth, local cultures cannot trump it. The main point is that the culture of human rights is inclusive of all and must maintain a standard by which all peoples and cultures can measure their own performances. Further, and as demonstrated in the present volume from a range of disciplines such as law, literature, history and anthropology, culture is not a mental prison but a particular outlook upon the world, for ever changing in response to new experiences and insights.

What are Norms? challenges the traditional Parsonian theory of the basis of social order and proposes a theoretical perspective that emphasises shared definitions of reality rather than personal motivation. The book begins by describing conceptions of good and bad in a Maya community. Then it explores how such normative beliefs relate to the actions of individuals and the organisation of society. Parsons' theory is not supported by previous research on attitudes and behaviour. The final chapter describes a new theoretical approach to norms and society that provides a better explanation of how people's norms relate to their actions and how norms change.

It is often claimed that humans are rational, linguistic, cultural, or moral creatures. What these characterizations may all have in common is the more fundamental claim that humans are normative animals, in the sense that they are creatures whose lives are structured at a fundamental level by their relationships to norms. The various capacities singled out by discussion of rational, linguistic, cultural, or moral animals might then all essentially involve an orientation to obligations, permissions and prohibitions. And, if this is so, then perhaps it is a basic susceptibility, or proclivity to normative or deontic regulation of thought and behavior that enables humans to develop the various specific features of their life form. This volume of new essays investigates the claim that humans are essentially normative animals in this sense. The contributors do so by looking at the nature and relations of three types of norms, or putative norms-social, moral, and linguistic-and asking whether they might all be different expressions of one basic structure unique to humankind. These questions are posed by philosophers, primatologists, behavioral biologists, psychologists, linguists, and cultural anthropologists, who have collaborated on this topic for many years. The contributors are committed to the idea that understanding normativity is a two-way process, involving a close interaction between conceptual clarification and empirical research.
