In the early modern period Dutch citizens could choose from a variety of judicial and infrajudicial forums to settle their disputes. In Leiden these institutions consisted of neighbourhoods, guilds, textile associations, civic militia, church councils, notaries, subordinate courts (a court established for settling matters about easement and other forms of urban servitude, and the so-called peacemaker court or vredemakers), and the official court or vierschaar. These forums dealt with tens of thousands of cases. In order to study the ways in which Leiden citizens used these institutions to put conflicts to an end, computer databases were made. These files were linked and analysed. The book shows that going to court was frequently used as an additional instrument of everyday social control. Many lawsuits were launched in the hope of accelerating the settlement of disputes, preferably without having to fight them through to the end. Generally, plaintiffs were focussed on restoring peace and social balance, rather than furthering their dispute. Most parties needed to live together amicably thereafter. They depended on each other as neighbours or colleagues. Instituting and concluding proceedings could put these relationships at risk. Besides, submitting a case to court was expensive and took a lot of time. All this gave people bargaining counter in settlement negotiations.

This study offers a new view on public services in the early modern Low Countries and answers the following questions: who provided public facilities in urban communities and in which ways did public amenities change in the period between 1500 and 1800? It throws light on the ways in which responsibilities were shared between city dwellers and the factors which influenced the allocation and reallocation of public services between the sixteenth and nineteenth centuries. The present study looks at those who provided various services to their communities, the ways in which they were rewarded and monitored, and the gain they may have sought. It focuses on the situation in the Low Countries, but in many respects, it also describes the development of the provision of public services in most towns in early modern Western Europe. The complex mixture of central and local, private and public, ecclesiastical and secular, individual and corporate initiatives, characterized – to a greater or lesser extent – urban communities everywhere in Western Europe. Above all, early modern towns were civil societies in which community services such as health care, poor relief, and public security were largely shaped and formed by conceptions of citizenship and collective interest.

The contributors to this volume examine the complex and dynamic role that Protestant majorities and minorities played in shaping the Reformations of the sixteenth and seventeenth centuries. In doing so, it offers an important perspective on the range of intellectual, social, economic, political, theological and ecclesiological factors that governed intra- and inter-confessional encounter in the early modern period. While the principal focus is on the situation of different Protestant majority and minority groups, many of the contributions also engage the relation of Protestants and Catholics, with a number also considering early modern Christian dialogue with Muslims and Jews. The volume is organised into five sections, which together provide a comprehensive picture of Protestant majorities and minorities. The first section explores intellectual trajectories, especially those which promoted confessional unity or sought to break down confessional boundaries. The second section, taking the neglected Spanish Reformation as an important case-study, examines the clandestine aspect of minority activities and the efforts of majorities to control and suppress them. The third section pursues a similar theme but examines it through the lens of Flemish and Walloon Reformed refugee communities in Germany and the Netherlands, demonstrating the way in which confessional factors could lead to the integration or exclusion of minorities. The fourth section examines marginal or peripheral Reformations, whether geographically or doctrinally understood, focussing on attempts to implement reform in the shadow of the Ottoman Empire. Finally, the fifth section looks at confessional identity and otherness as a principal theme of majority and minority relations, providing both theoretical and practical frameworks for its evaluation.

The city is a place to find shelter, a market place, and an elevator for social mobility and success. But the city is also a place that frightens people and that can marginalize newcomers. Living in the City tries to understand what pulls people to the city since the High Middle Ages, focusing on one of the earliest urbanized regions in the world, the Low Countries. The book is a quest for new insights that leads the reader from Medieval Ghent and Bruges, through the Dutch Golden Age and the mass urbanization in the age of Industrialization to the present Eurodelta. A region that emerged in the last century with Antwerp, Rotterdam and Amsterdam as nodal points in a global urban network. To understand the motivations of so many to settle in cities this book focuses on a wide variety of urban institutions. What was the role of churches, guilds and businesses, but also theaters, architecture, parks and pavements? What were the cultural, economic, social, political and spatial dynamics that transformed cities into centers of creativity and innovation? How did the attractiveness of cities change over time, when cities lost their autonomy and became part of the nation state and global forces? In this book a team of internationally reknown scholars (in the field of history, art, literature, economy and the social sciences) look for continuity and change in the last eight centuries of urban developments in one of the most remarkable urban regions of the world.

The Uses of Justice in Global Perspective, 1600–1900 presents a new perspective on the uses of justice between 1600 and 1900 and confronts prevailing Eurocentric historiography in its examination of how people of this period made use of the law. Between 1600 and 1900 the towns in Western Europe, the Kingdoms in Eastern Europe, the Empires in Asia and the Colonial States in Asia and the Americas were all characterised by a plurality of legal orders resulting from interactions and negotiations between states, institutions, and people with different backgrounds. Through exploring how justice is used within these different areas of the world, this book offers a broad global perspective, but it also adopts a fresh approach through shifting attention away from states and onto how ordinary people lived with and made use of this ‘legal pluralism’. Containing a wealth of extensively contextualised case studies and contributing to debates on socio-legal history, processes of state formation from below, access to justice, and legal pluralism, The Uses of Justice in Global Perspective, 1600–1900 questions to what degree top-down imposed formal institutions were used and how, and to what degree, bottom-up crafted legal systems were crucial in allowing transactions to happen. It is ideal for students and scholars of early modern justice, crime and legal history.

This book charts the lives of (suspected) thieves, illegitimate mothers and vagrants in early modern Frankfurt. The book highlights the gender differences in recorded criminality and the way that they were shaped by the local context. Women played a prominent role in recorded crime in this period, and could even make up half of all defendants in specific European cities. At the same time, there were also large regional differences. Women’s crime patterns in Frankfurt were both similar and different to those of other cities. Informal control within the household played a significant role and influenced the prosecution patterns of authorities. This impacted men and women differently, and created clear distinctions within the system between settled locals and unsettled migrants.
