The fifteenth and final volume of the series The Making of Modern Freedom, this book explores a variety of issues surrounding questions of human rights and freedom in China. The chapters suggest very significant realms of freedom, with or without the protection of law, in the personal, social, and economic lives of people in China before the twentieth century. This was recognized, and partly codified, in the early twentieth century, when legal experts sought to establish a republic of laws and limits. The process of legal reform, however, would be placed firmly in the service of strengthening the post-imperial Chinese nation-state, culminating after 1949 in despotism unparalleled in Chinese history. Nevertheless, the last decades of the twentieth century and the first years of our own would witness a slow, steady, but unmistakable reassertion of realms of personal and communal autonomy that show, even in an era of strong states, at least the prospect of institutionalized freedoms.

The growth of rights defence movements in China reflects the increasing capacity of Chinese citizens to shape their own civic discourse in order to achieve diverse goals. Rights defence campaigns have taken novel forms which are unprecedented in China, including the use of the Internet by rights campaigners, the development of rights entrepreneurs, and the selection of representatives and leaders in rights defence campaigns. Defending Rights in Contemporary China offers the first comprehensive analysis of the emergence and development of notions of rights defence, or weiquan, in China. Further, it shows that rights defence campaigns reflect the changing lives and priorities of Chinese citizens, both urban and rural, and the changing distribution of power in China. The Chinese government first used rights defence to promote the law and protect the rights of the weak. But the use of rights defence strategies by private citizens, and lawyers also demonstrates changing power structures – in areas as diverse as private property rights, rights for the handicapped, corruption claims and grievances with officials. In this book, Jonathan Benney argues that the idea of rights defence has gone from being a tool of the government to being a tool to attack the party-state, and explores the consequences of this controversial activist movement. This book questions the political logic of foregrounding cultural collectives in a world shaped by globalization and neoliberalization. Throughout the world, it is no longer only individuals, but increasingly collective "cultures" who are made responsible for their own regulation, welfare and enterprise. This appears as a surprising shift from the tenets of classical liberalism which defined the ideal subject of politics as the "unencumbered self"- the free, equal and self-governing individual. The increasing promotion and recognition of cultural rights in international legislation, multiculturalism, and public debates on "culture" as a political problem more generally indicate that culture has become a more central terrain for governance and struggles around rights and citizenship. On the basis of case studies from China, Latin America, and North America, the contributors of this book explore the links between culture, civility, and the politics of citizenship. They argue that official reifications of "culture" in relation to citizenship, and even the recognition of cultural rights, may obey strategies of governance and control, but that citizens may still use new cultural rights and networks, and the legal mechanisms that have been created to protect them, in order to pursue their own agendas of empowerment. From civil war to Japanese occupation and communist revolution to market transition, China has undergone and continues to experience enormous economic, political, and social change. In Remaking Families in Contemporary China, Xiaoying Qi explores a number of emerging family practices in China today that result from these ongoing changes. Drawing upon 178 in-depth interviews with young adults, married adults, and grandparents throughout China, she finds that ordinary people are transforming their patterns of behavior and expectations in dealing with a changing world, and in so doing, remaking their families. Filling a gap in the current research, Qi investigates novel aspects of family life, such as the practice of providing a child with its mother's surname rather than its father's in an intriguing exercise of veiled patriarchy. She also identifies a new category of floating grandparents, which consists of rural and small-town grandparents who join their adult children in the massive labor migration that characterizes the modern Chinese workforce in order to provide childcare. In addition, Qi examines other often overlooked topics, including spousal intimacy, divorce, and remarriage and co-habitation in later life. Complaint systems have existed in China for many years, and in 2004, a debate took place in the People’s Republic of China (PRC) over the Letters and Visits System (xinfang zhidu), which was designed to allow people to register complaints with the upper levels of the government. However, both parties generally overlooked several different complaint systems that had preceded the Letters and Visits System during China’s history. Indeed, despite the rich heritage of numerous complaint systems throughout China’s past, most studies of complaint systems in China have paid little attention to the origins, development, practices, impact, and nature of similar institutions in the longue durée of Chinese history. Presenting a comprehensive study of complaint systems in Chinese history from early times to the present, this important book fills the gap in existing literature on complaint systems in China. Drawing on primary sources, Qiang Fang analyses the significance of continuities and changes in historical complaint systems for contemporary China, where the state continues to be nominally strong, but actually fragile. Unlike other major theories of popular resistance to the state in China, such as ‘everyday resistance’, ‘rightful resistance’ and resistance ‘as legal rights’, this book develops the theory that behind Chinese complaint systems, there was a mentality of ‘natural resistance’ that has been deeply embedded in Chinese culture, political philosophy, and folk religion for millennia. Given this history, Fang concludes that it is likely that some form of complaint system will continue to exist, and by helping to mitigate the increasing demands of the Chinese state on the Chinese, will serve to strengthen the state. An essential contribution understanding the strengths, weaknesses, and various roles of the Letters and Visits System in contemporary China, as well as the systems that have preceded it throughout China’s long history, this book will be of huge interest to students and scholars of Chinese history, politics and law.

Many studies of government in China either simply describe the political institutions or else focus, critically, on the weaknesses of the system, such as corruption or the absence of Western-style democracy. Authors of these studies fail to appreciate the surprising ability of China’s government to rapidly transform a once impoverished economy and to recover from numerous crises from 1978 to the present. This book, on the other hand, takes a more balanced, more positive view. This view is based on a study of changes in China’s institutions for coping with critical crises in governance since 1978. These changes include better management of leadership succession, better crisis management, improved social welfare, the management of society through treating different social groups differently depending on their potential to rival the Party state, and a variety of limited, intra-party and grassroots democracy. This book applies to the Chinese model the term “pragmatic authoritarianism.” It explains changes to and the likely future direction of China’s governance model.
