En el pasado he manifestado, insistentemente, mi preocupación por la necesidad de delimitar el objeto de la jurisdicción de lo contencioso administrativo en nuestro país. Ello ha tenido una motivación de doble vía: una conceptual y de comprensión institucional, y otra de perplejidad por el sinnúmero de dudas de competencia entre la jurisdicción ordinaria y la jurisdicción de lo contencioso administrativo. La razón de la primera tiene una altísima carga académica: vivir en un Estado con una rara configuración institucional de la rama judicial, donde en el contexto de una pluralidad de jurisdicciones se esboza desde hace casi ciento diez años una jurisdicción de lo contencioso administrativo poco común en el derecho comparado, con un indiscutible referente foráneo que le sirvió de impulso, pero, también, fruto de acontecimientos históricos propios y precisos, lo cual supone de manera bastante natural y con tintes de pretensiones lógicas, preguntarse por su esencia, naturaleza y razón de ser. Este enfoque necesariamente ha llevado a interrogarme en el pasado, de manera puntual, el porqué de su existencia.
