The reach of free movement within the EU Internal Market and what constitutes a restriction are the topics of this book. For many years the tension between free movement and restrictions have been the subject of intense discussion and controversy, and this includes the constitutional reach of the rights conferred by the Treaty of Lisbon. Anything that makes movement less attractive or more burdensome may constitute a restriction. Restrictions may be justified, but only if proportionate. The reach of free movement is fundamental to the Internal Market, both for the economic constitution and increasingly for individual rights in a European legal order that provides constitutional guarantees for rights, exceeding those of free movement. The interaction between fundamental rights and fundamental freedoms to movement distinguishes the EU legal order from the national legal systems. The book falls into four parts, ‘The reach of free movement’, ‘Justifications and Proportionality’, ‘Fundamental rights’, and ‘Looking Abroad’. The clear discussion of the fundamentals and dilemmas regarding the subject of this book should prove useful for academics, practitioners, graduate students as well as EU officials and judges wishing to stay updated on the ongoing scholarly debate regarding relevance to case law. These four conceptual and critical essays on state and society in contemporary China argue vigorously against the grain of prevailing scholarly interpretation. In substantive content, they explore two major themes from different historical and theoretical points of departure. First, the author argues that the party/state under Mao fell far short of the full control over China's peasant society that outside observers often assumed it had achieved. She shows, instead, how the Maoist state frequently pursued policies that in fact had the ironic effect of strengthening the resistance of rural communities against the central political apparatus. Second, she contends that once the true limitations on the Maoist state's power in rural areas are rightly understood, it becomes clear that one effect of the post-Mao economic and political reforms may be to enhance rather than to diminish the state's authority in the countryside — despite all the reformists' rhetoric to the contrary. These essays on "how to think about the Chinese state" are designed to stimulate debate about assumptions and methods in the field of Chinese political analysis. The controversies they raise, however, make them highly relevant to scholars outside Chinese studies who are interested in theories of the state, in the interrelations of state and society, and in the fate of the peasantry under socialism.

James Kern Feibleman, born in New Orleans in 1904 of Jewish parents, had an early career as poet, short story writer and novelist, and assistant manager of a department store and partner in an investment company. His formal higher educa tion did not extend beyond a semester of study at the Uni versity of Virginia. In 1942 he joined the faculty of the Tulane College of Arts and Sciences as a lecturer in English, and soon thereafter transferred to Philosophy. Appointed full professor of philoso phy in 1945, he became head of the Arts and Sciences depart ment in 1951, and university chairman in 1957. He has also served as special lecturer in the Department of Psychiatry at Louisiana State University Medical School from 1958 to 6 19 7. In 1969, upon his retirement from the department chairman ship, Professor Feibleman was appointed in the W.R. Irby Chair in Philosophy. In 1974 he was appointed Andrew W. Mellon Professor in the Humanities, having the honor of being not only the first occupant of this newly established chair but also perhaps the only person ever selected from the university faculty for this honor. In 1975, upon his final retirement from the university, the faculty approved his appointment as Emer itus Professor of Philosophy.
