This volume explores a variety of forms of transnational private governance where non-state actors cooperate across borders to establish rules and standards accepted as legitimate by other agents. Transnational private governance is a core feature of the devolution of power that we observe in the global realm and that is bringing about new forms of authority. Transnational Private Governance provides theoretically and empirically informed insights into the interactions between states and non-state actors including domains beyond intergovernmental organizations, conventional non-governmental organizations, and multinational enterprises, covering a wide range of arrangements, from highly formal devolutions of power to lax and informal platforms of interaction between private actors. In the 1990s and mid-2000s, turbulent political and social protests surrounded the issue of private sector involvement in providing urban water services in both the developed and developing world. Water on Tap explores examples of such conflicts in six national settings (France, Bolivia, Chile, Argentina, South Africa and New Zealand), focusing on a central question: how were rights and regulation mobilized to address the demands of redistribution and recognition? Two modes of governance emerged: managed liberalization and participatory democracy, often in hybrid forms that complicated simple oppositions between public and private, commodity and human right. The case studies examine the effects of transnational and domestic regulatory frameworks shaping the provision of urban water services, bilateral investment treaties and the contributions of non-state actors such as transnational corporations, civil society organisations and social movement activists. The conceptual framework developed can be applied to a wide range of transnational governance contexts.

Transnational communities are social groups that emerge from mutual interaction across national boundaries, oriented around a common project or 'imagined' identity. This common project or identity is constructed and sustained through the active engagement and involvement of at least some of its members. Such communities can overlap in different ways with formal organizations but, in principle, they do not need formal organization to be sustained. This book explores the role of transnational communities in relation to the governance of business and economic activity. It does so by focusing on a wide range of empirical terrains, including discussions of the Laleli market in Istanbul, the institutionalization of private equity in Japan, the transnational movement for open content licenses, and the mobilization around environmental certification. These studies show that transnational communities can align the cognitive and normative orientations of their members over time and thereby influence emergent transnational governance arrangements.
