All property rights result in the conferral of three qualities or capacitites, namely a management power, an ability to receive income or benefits, and an ability to sell or alienate the interest. However the transition from open access to property rights for natural resources has drawn attention to just how we define whether "particular rights" are in fact property rights. Property in the more familiar sense of land and buildings conveys a tenor of regularity, constancy, and fixity- this is not so with the new forms of property which are inherently 'sui generis'. Property Rights: Philosophic Foundations, first published in 1977, comprehensively examines the general justifications for systems of private property rights, and discusses with great clarity the major arguments as to the rights and responsibilities of property ownership. In particular, the arguments that hold that there are natural rights derived from first occupancy, labour, utility, liberty and virtue are considered, as are the standard anti-property arguments based on disutility, virtue and inequality, and the belief that justice in distribution must take precedence over private ownership. Lawrence Becker goes on to contend that there are four sound lines of argument for private property that, together with what is sound in the anti-property arguments, must be co-ordinated to form the foundations of a new theory. He therefore expounds a concise but sophisticated theory of property that is relevant to the modern world, and concludes by indicating some of the implications of his theory.

The aim of this paper is to critically revise the well-established attitude towards economic theorizing on property as a complete bundle of rights over well-defined uses. While some authors have previously introduced the incomplete dimension of property in their discourse, they have conceptualized incompleteness either in terms of undiscovered uses, weakly enforced rights or weakly partitioned rights. We move from a different idea of incompleteness, namely the initial lack of attribution of well-defined rights over new undefined uses of an asset. We suggest a possible direction of future research towards an economic theory of incomplete property, namely a theory of property intended as an incomplete bundle of defined and undefined rights over the uses of an asset. The elements of the theory here delineated may contribute to reconcile and to integrate under a common framework some of the main debated issues on the nature and the dynamics of property rights. Moreover, the theory shows the existence of a complex coevolutionary relationship between property and externalities.

The author presents a rich and thought-provoking account of one of modernity's staunchest defenders of the right to ownership of private property, and this includes a probing analysis of Locke's religious-cum-secular arguments. Using a range of modern and postmodern political philosophers as well as legal theorists, the author argues in favour of what he calls "personal ownership" as a possible alternative to exclusive private ownership. He claims that this overcomes some of the snags inherent in Locke's theory of private property while remaining more true to the key principles of sufficiency and non-spoliation. Like Locke, the author affirms the human right of all to property, but goes farther to propose this new and refreshing theory of personal ownership that is based on the norm of responsibility, inclusiveness, and environmental sustainability.

This book constitutes volume two of a two volume examination of development community land issues in Southern Africa. Following from volume one Southern African Development Community Land Issues, this book considers the possibility of a new, sustainable land relations policy for Southern African Development Community States (SADC) that are currently mired up in land disputes that have become subject of domestic, regional and international tribunals. Chigara demonstrates that land relations in the SADC have always been, and will perhaps remain, a matter for constitutional regulation. Because constitutional laws are distinctive from other laws only by constitutional design, legal contests appear to be the least likely means for settlement in the sub-region. Only human rights inspired policies, that respond to the call for social justice by acknowledging both the current and the underlying contexts to the disputes, hold the most potential to resolve these disputes. The book recommends efficient pedagogical counter-apartheid-rule psychological distortions regarding the significance of human dignity (PECAPDISH) as a pre-requisite and corollary to the dismantling of the salient physical legacy of apartheid-rule in affected SADC States.
