Valérie Cabanes est juriste en droit international, spécialisée dans les droits de l'homme. C’est une lacune du droit international : rien aujourd'hui ne permet aux victimes d’injustices environnementales de réclamer l’application de leurs droits. Aucune sanction n’est prévue pour ceux qui menacent les Droits de la nature alors qu’il en va de la pérennité des conditions de la vie sur terre. Les Droits de la nature doivent accorder aux écosystèmes des droits à l’existence qui peuvent être revendiqués en justice. Ils proposent la reconnaissance du crime « d’écocide » pour les atteintes les plus graves contre l’environnement que les États et les entreprises non seulement permettent, mais parfois encouragent. Ces principes permettent de considérer la nature comme un sujet de droits plutôt que comme un objet. Cela remet en cause notre conception de la place de la nature par rapport à l’humanité. Car il ne saurait y avoir de Droits Humains et de droit des générations actuelles et futures à bénéficier d’un environnement sain et viable sans la reconnaissance des Droits de la nature et qu’émergent des nouveaux modèles de gouvernance mondiaux. Ce livre propose des évolutions du droit international pour que soit pris en compte la réalité des excès de notre monde industrialisé. Cela implique de faire du vivant un sujet de droit. C’est donc aussi une révolution philosophique du droit qui est proposée dans ce livre. Après la conquête des droits individuels, politiques et sociaux, à l’heure où de graves menaces pèsent sur la nature et l’humanité, il convient de concevoir et d’acquérir de nouveaux droits sécurisant la Terre et ses habitants. Ce livre a été écrit dans le cadre du troisième Tribunal international des droits de la Nature qui s’est tenu à Paris en décembre 2015, parallèlement à la COP21. Un livre nécessaire pour faire de la nature un sujet de droit à part entière. Anthropocene and Cosmopolitan Citizenship criticizes the Westphalia system of international relations and, as an alternative, proposes cosmopolitan citizenship. The book offers a critique of the theory of international relations based on the Westphalian system and the principle of national sovereignty. At the end of the Second World War, the two superpowers agreed on a new international order that, to this day, has prevented a new world war. This era is over. The collapse of the Soviet Union and the economic and political affirmation of new international powers – such as China, India and Brazil – have generated a multipolar world, in which growing tensions between great and small powers are manifested, up to the threat of nuclear war. To this threat, a second one has been added: the possible collapse of the biosphere, an epoch called the Anthropocene, because the pollution of nature is suffocating the life of every living species on the Planet, including Homo sapiens. The United Nations can be viewed as the first step towards a post-Westphalian system, and the European Union represents an alternative model for peaceful relationships among national peoples. The book’s methodology draws on an interdisciplinary relationship between social sciences and nature sciences to provide a European foreign policy strategy that shows how the European Union can play a crucial role in current international politics, helping build a just world in harmony with nature, including by calling for a Global Green Deal and an Earth Constitution. The integration of the national peoples of the European Union shows that supranational citizenship is possible and that national independence is compatible with peaceful international interdependence. The author explores how this can be achieved and how alternatives have failed, with reference to federalism, ecologism, liberalism, democracy, socialism, nationalism, security and patriotism. The solutions and tools generally offered to policymakers on environmental issues – such as carbon pricing and environmental taxation – most often emanate from neoclassical economists. This book shows that the tools of these economists are ineffective for the job and must be replaced by methods from the sphere of ecological accounting. The work has four main themes: First, the book provides a presentation and criticism of the tools traditionally proposed by neoclassical economists. Adopting a historical perspective, this section shows how these tools have evolved over time and explores some of the theoretical criticisms which have been leveled at them. Second, the book shows how mainstream economists have moved away from more pragmatic and efficient solutions because of their ignorance of the realities of management, in particular, corporate accounting, and their ideologically driven desire to avoid attacking the capitalist model. And finally the book considers the concrete possibilities of a rapid application of these new tools to combat the immediate threats we are facing.
