La presente obra recoge los resultados obtenidos por el Proyecto de Investigación “Nuevas propuestas político-criminales para el delito de conducción sin licencia administrativa de vehículos a motor o ciclomotores cometidos por menores de edad”, financiado por la Dirección General de Tráfico (Ministerio del Interior). Las líneas de investigación desarrolladas y presentadas pueden delimitarse en tres ámbitos:A) Un exhaustivo y detallado análisis del artículo 384 del Código Penal, trasladándolo al ámbito de los menores de edad, siendo objeto de un particular análisis dogmático y jurisprudencial la evolución del delito; la identificación del bien jurídico protegido; la doble incriminación de la conducta, vía penal o administrativa; las distintas modalidades comisivas y su concurrencia práctica; el grado de culpabilidad necesario; la responsabilidad penal de otras personas participantes en el hecho criminal; medidas imponibles; concurso de delitos vs concurso de infracciones; reincidencia; simulación del delito como forma de encubrimiento; el vehículo a motor como instrumento del delito y el procedimiento de menores.B) Estudio empírico realizado sobre una muestra de 100 resoluciones judiciales dictadas en los juzgados de Menores de Almería, Granada, Jaén y Murcia en el año 2017 por delito de conducción sin licencia administrativa de vehículos a motor o ciclomotores cometido por menores. Entre otras variables analizadas destacan: edad, sexo, nacionalidad, nivel educativo, trabajo, presencia de enfermedad mental, modalidad comisiva particular, consumo de alcohol/drogas, características del vehículo empleado, titularidad, procedimiento de la detección del delito, medida aplicable al menor, antecedentes penales ( ).C) Estudio de Derecho Comparado. Se han analizado las legislaciones italiana, francesa y británica con el propósito de conocer otros modelos incriminatorios y poder exportar nuevas propuesta político-criminales a nuestro ordenamiento jurídico.

Although sexual violence directed at both females and males is a reality in many on-going conflicts throughout the world today, accountability for the perpetrators of such violence remains the exception rather than the rule. While awareness of the problem is growing, more effective approaches are urgently needed for the investigation and prosecution of conflict-related sexual violence crimes. Upon its establishment in 1993, the Office of the Prosecutor (OTP) of the International Criminal Tribunal for the Former Yugoslavia (ICTY) began the challenging task of prosecuting the perpetrators of conflict-related sexual violence crimes, alongside the many other atrocities committed during the conflicts in the former Yugoslavia. This book documents the experiences, achievements, challenges, and fundamental insights of the OTP in prosecuting conflict-related sexual violence crimes at the ICTY over the past two decades. It draws on an extensive dossier of OTP documentation, court filings, trial exhibits, testimony, ICTY judgements, and other materials, as well as interviews with current and former OTP staff members. The authors provide a unique analytical perspective on the obstacles faced in prioritizing, investigating, and prosecuting conflict-related sexual violence crimes.
