The International Court of Justice (in French, the Cour internationale de justice), also commonly known as the World Court or ICJ, is the oldest, most important and most famous judicial arm of the United Nations. Established by the United Nations Charter in 1945 and based in the Peace Palace in the Hague, the primary function of the Court is to adjudicate in disputes brought before it by states, and to provide authoritative, influential advisory opinions on matters referred to it by various international organisations, agencies and the UN General Assembly. This new work, by a leading academic authority on international law who also appears as an advocate before the Court, examines the Statute of the Court, its procedures, conventions and practices, in a way that will provide invaluable assistance to all international lawyers. The book covers matters such as: the composition of the Court and elections, the office and role of ad hoc judges, the significance of the occasional use of smaller Chambers, jurisdiction, the law applied, preliminary objections, the range of contentious disputes which may be submitted to the Court, the status of advisory opinions, relationship to the Security Council, applications to intervene, the status of judgments and remedies. Referring to a wealth of primary and secondary sources, this work provides international lawyers with a readable, comprehensive and authoritative work of reference which will greatly enhance understanding and knowledge of the ICJ. The book has been translated and lightly updated from the French original, R Kolb, La Cour international de Justice (Paris, Pedone, 2013), by Alan Perry, Solicitor of the Senior Courts of England and Wales. Winner of the 2014 American Society of International Law Certificate of Merit for High Technical Craftsmanship and Utility to Practicing Lawyers and Scholars: 'Robert Kolb's International Court of Justice provides a magisterial, lucid study of its subject. The breadth and depth of the treatment are impressive: Kolb takes the reader from the history of the Court, to its role in international society, to the more technical questions concerning its composition, powers and procedures, to the development of its jurisprudence, and to its future. The finely grained discussion provides much more than a mere survey of the Court's constitutive instruments and decisions. It engages the Court as an institution and asks how it actually operates, and secures efficacy and authority in doing so. The book's careful and detailed coverage of the Court's legal framework and operation will benefit practitioners and scholars alike. There is no doubt that Kolb's volume immediately takes a place among the authoritative references on the Court.' The Handbook of Moral Development is the definitive source of theory and research on the origins and development of morality in childhood and adolescence. It explores morality as fundamental to being human and enabling individuals to acquire social norms and develop social relationships that involve cooperation and mutual respect. Since the publication of the second edition, groundbreaking approaches to studying moral development have invigorated debates about how to conceptualize and measure morality in childhood and adolescence. The contributors of this new edition grapple with these questions from different theoretical perspectives and review cutting-edge research. The handbook, edited by Melanie Killen and Judith G. Smetana, includes chapters on parenting and socialization, values, emergence of prejudice and social exclusion, fairness and access to resources, moral reasoning and children’s rights, empathy, and prosocial behaviors. Morality is discussed in the context of families, peers, schools, and culture. Thoroughly updated and expanded, the third edition features new chapters on the following: Morality in infancy and early childhood Cognitive neuroscience perspectives on moral development Social responsibility in the context of social and racial justice Conceptions of economic and societal inequalities Stereotypes, bias, and discrimination Victimization and bullying in peer contexts Reflecting the interdisciplinary nature of the study of moral development, this edition contains contributions from sixty scholars in developmental science, social neuroscience, comparative and evolutionary psychology, and education, representing research conducted around the world. Originally published by Hersch Lauterpacht in 1947, this book presents a detailed study of recognition in international law, examining its crucial significance in relation to statehood, governments and belligerency. The author develops a strong argument for positioning recognition within the context of international law, reacting against the widely accepted conception of it as an area of international politics. Numerous examples of the use of law and conscious adherence to legal principle in the practice of states are used to give weight to this perspective. This paperback re-issue in 2012 includes a newly commissioned Foreword by James Crawford, Whewell Professor of International Law at the University of Cambridge and a Fellow of Jesus College, Cambridge.

The Concept Of The Common Heritage Of Mankind In International Law written by Kemal Baslar and has been published by BRILL this book supported file pdf, txt, epub, kindle and other format this book has been release on 2024-02-06 with Law categories.

The concept of the common heritage of mankind is one of the most extraordinary developments in recent intellectual history and one of the most revolutionary and radical legal concepts to have emerged in recent decades. The year 1997 marks the thirtieth anniversary of the advent of the concept in the domain of public international law. Ever since its emergence, it has become evident that no other concept, notion, principle or doctrine has brought as much intensive debate, controversy, confrontation and speculation as the common heritage phenomenon did. This is because it is a philosophical idea that questions the regimes of globally important resources regardless of their situation, and requires major changes in the world to apply its provisions. In other words, the application and enforcement of the common heritage of mankind require a critical reexamination of many well-established principles and doctrines of classical international law, such as acquisition of territory, consent-based sources of international law, sovereignty, equality, resource allocation and international personality. This book aims to explore the legal theory and implications of the concept of the common heritage of mankind. It addresses almost all aspects of the concept in the light of the experience of three decades. The author takes into account the elements of the common heritage concept in the fields of jurisprudence, outer space law, the law of the sea, the law of Antarctica, international environmental law, human rights and general principles of public international law. It tries to develop a normative framework through which the concept may offer alternatives for the governance of the global commons.

Hyper Text Theory written by George P. Landow and has been published by Johns Hopkins University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 1994-12-05 with Literary Criticism categories.

In his widely acclaimed book Hypertext George P. Landow described a radically new information technology and its relationship to the work of such literary theorists as Jacques Derrida and Roland Barthes. Now Landow has brought together a distinguished group of authorities to explore more fully the implications of hypertextual reading for contemporary literary theory. Among the contributors, Charles Ess uses the work of Jürgen Habermas and the Frankfurt School to examine hypertext's potential for true democratization. Stuart Moulthrop turns to Deleuze and Guattari as a point of departure for a study of the relation of hypertext and political power. Espen Aarseth places hypertext within a framework created by other forms of electronic textuality. David Kolb explores what hypertext implies for philosophy and philosophical discourse. Jane Yellowlees Douglas, Gunnar Liestol, and Mireille Rosello use contemporary theory to come to terms with hypertext narrative. Terrence Harpold investigates the hypertextual fiction of Michael Joyce. Drawing on Derrida, Lacan, and Wittgenstein, Gregory Ulmer offers an example of the new form of writing hypertextuality demands.
