It is increasingly implausible to speak of a purely domestic abortion law, as the legal debates around the world draw on precedents and influences of different national and regional contexts. While the United States and Western Europe may have been the vanguard of abortion law reform in the latter half of the twentieth century, Central and South America are proving to be laboratories of thought and innovation in the twenty-first century, as are particular countries in Africa and Asia. Abortion Law in Transnational Perspective offers a fresh look at significant transnational legal developments in recent years, examining key judicial decisions, constitutional texts, and regulatory reforms of abortion law in order to envision ways ahead. The chapters investigate issues of access, rights, and justice, as well as social constructions of women, sexuality, and pregnancy, through different legal procedures and regimes. The waning influence of the Catholic church in the ethical and political debate For centuries the Catholic Church was able to impose her ethical rules in matters related to the intimate, that is, questions concerning life (from its beginning until its end) and the family, in the so-called Catholic countries in Western Europe. When the polity started to introduce legislation that was in opposition to the Catholic ethic, the ecclesiastical authorities and part of the population reacted. The media reported massive manifestations in France against same-sex marriages and in Spain against the de-penalization of abortion. In Italy the Episcopal conference entered the political field in opposition to the relaxation of several restrictive legal rules concerning medically assisted procreation and exhorted the voters to abstain from voting so that the referendum did not obtain the necessary quorum. In Portugal, to the contrary, the Church made a “pact” with the prime minister so that the law on same-sex marriages did not include the possibility of adoption. And in Belgium the Episcopal conference limited its actions to clearly expressing with religious, legal, and anthropological arguments its opposition to such laws, which all other Episcopal conferences did also. In this book, the authors analyse the full spectrum of the issue, including the emergence of such laws; the political discussions; the standpoints defended in the media by professionals, ethicists, and politicians; the votes in the parliaments; the political interventions of the Episcopal conferences; and the attitude of professionals. As a result the reader understands what was at stake and the differences in actions of the various Episcopal conferences. The authors also analyse the pro and con evaluations among the civil population of such actions by the Church. Finally, in a comparative synthesis, they discuss the public positions taken by Pope Francis to evaluate if a change in Church policy might be possible in the near future. Research by GERICR (Groupe européen de recherche interdisciplinaire sur le changement religieux), a European interdisciplinary research group studying religious changes coordinated by Alfonso Pérez-Agote.

This open access book engages with the concept of reproductive justice by exploring case studies of struggles around abortion in the context of rising anti-genderism, religious fundamentalism, and ethno-nationalism. Based on rich qualitative data offering in-depth analyses from different geographical, political and cultural contexts, the book explores how reproductive justice is understood, contested and given meaning. Chapters further develop the Black feminist concept of reproductive justice in a critical dialogue with postcolonial theory and explore the strength of transnational feminist practices. The women’s movement is a central, complex, and evolving socio-political actor in any national context. Vital to advancing gender equity and gendered relations in every contemporary society, the organization and mobilization of women into social movements challenges patriarchal values, behaviours, laws, and policies through collective action and contention, radically altering the direction of society over time. Twenty-First-Century Feminismos examines ten case studies from eight different countries in Latin America and the Caribbean to better understand the ways in which women’s and feminist movements react to, are shaped by, and advance social change. A closer look at women’s movements in Argentina, Brazil, Chile, Colombia, El Salvador, Haiti, Mexico, and Uruguay uncovers broader recurrent patterns at the regional level, such as the persistence of certain grievances historically harboured by regional movements, the rise in prominence of varying claims, and the emergence of novel organizational structures, repertoires, and mobilization strategies. Dissimilarities among the cases are also brought to light, including the composition of these movements, their success in effecting policy change in specific areas, and the particular conditions that surround their mobilization and struggles. Whilst the politics of reproduction have been at the heart of feminist struggles for over a century and a half, their analysis has not yet come to occupy a central place in the interdisciplinary study of citizenship. This volume takes up the challenge posed by Bryan Turner, when he noted "the absence of any systematic thinking about familial relations, reproduction and citizenship" (2008), and offers the first major global collection of work exploring this nexus of practices and political contestations. The book brings together citizenship scholars from across Europe, the Americas, and Australia to develop feminist and queer analyses of the relationship between citizenship and reproduction, and to explore the ways in which citizenship is reproduced. Extending the foundational work of feminist political theorists and sociologists who have interrogated the public/private dichotomy on which traditional civic republican and liberal understandings of citizenship rest, the contributors examine the biological, sexual, and technological realities of natality, and the social realities of the intimate intergenerational material and affective labour that are generative of citizens, and that serve to reproduce membership of, and belonging to, states, nations, societies, and thus of "citizenship" itself. This book was published as a special issue of Citizenship Studies.
