Excerpt from Archiv für Katholisches Kirchenrecht, 1877, Vol. 38: Mit Besonderer Rücksicht auf das Vaticanische Concil, Sowie auf Deutschland, Oesterreich und die Schweiz Inhaltlich bringt dieses Gesetz nichts Neues, was nicht schon früher in der Praxis durchgeführt und von Constantin I. Als rechts kräftig anerkannt wäre. Aber dürfen wir von Constantius dessen ganze sonstige Handlungsweise Zeugniss gibt von seiner Abneigung gegen die_ katholische Kirche und deren Bischöfe, erwarten, dass er hier auf einmal aus Wohlwollen ein Gesetz erlässt, worin er den Bischöfen, aus Achtung vor ihrem Stande und ihrer Würde als eigenen und einzigen Gerichtshof die Kirche selbst zuwies vor deren Tribunale alle Vergehen der Bischöfe abgeurtheilt werden sollten? Die gegenwärtige Verordnung ist datirt vom Jahre 355, also zu einer Zeit, wo Constantius nach dem Tode seiner beiden katholischen Brüder offen als Feind der katholischen Kirche auf trat, wo er durch Beseitigung ihrer vorzüglichsten Verfechter der glaubenstreuen Bischöfe, die Kirche zu vernichten und an ihre Stelle die arianische Häresie zu stellen bestrebt war. Hier ist eine Unter suchung nothwenüg, ob dieses für Kirche und Bischöfe scheinbar günstige Gesetz in Wahrheit nicht darauf hinaus lief, die eine wie die anderen zu benachtheiligen.
