Bulgaria's and Romania's transition from central planning to market economy has been long and difficult. The lateness of their transformation made their entry into the European Union possible only three years later (in 2007) than the other transition economy candidates for membership. The delayed transition and 'Europeanization' of Bulgaria and Romania have been reflected in the patterns of their inward foreign direct investment. Almost three quarters of these inflows accumulated since the beginning of transition have been attracted after the Thessaloniki Summit in 2003 which locked the date of their entry into the European Union. Moreover, there are questions surrounding the quality and the development impact of inbound foreign direct investment. Despite the major labour cost and corporate tax advantages of locations Bulgaria and Romania, these countries have attracted relatively few efficiency seeking projects, mostly in garments and footwear, an industry that may be under global competitive threat. Potentially, however, they could become the 'workbench' within the European Union for many other industries, too. In the near future, the main challenge of these low-income locations is how to ensure that their investment potential materializes. To arrive there, it is important to further improve the business environment (as a continuation of the impressive pre-accession efforts) by strengthening the judiciary system, fighting against corruption and in Bulgaria, against organized crime.

This book fills a significant gap in recent literature on European Union politics by examining the EU’s ‘other’ eastern enlargement, completed in 2007 with the accession of Bulgaria and Romania. It focuses on both the process and the effects of the 2007 enlargement within the wider context of the post-communist countries’ accession to the EU, and, more broadly, within the context of the history of EU enlargement. The book brings together in-depth analyses of a wide range of issues, both from a comparative perspective and through single case studies. Individual contributions shed new light onto EU enlargement through a theoretical re-evaluation of the ‘strategic action’ paradigm, as well as through historical analyses of the 2007 enlargement and of its implications for future EU enlargements. Further insight into the process of EU enlargement is gained through systematic exploration of the impact of accession on policy-making and institutional structures in Bulgaria and Romania. Altogether, the contributions exemplify the multi-faceted nature of EU enlargement and accession, as well as the extent to which the process of acceding to the EU is not completed with membership, either for the EU or for the candidate countries. The book contains a detailed analysis and evaluation of the powers of the Union to harmonise substantive criminal law and the influence of European Union law on national substantive criminal law; of the evolution of the Europeanisation of prosecution from horizontal co-operation between national criminal justice to forms of vertical integration in the field of prosecution as embodied in the evolution of Eurojust and the establishment of a European Public Prosecutor's Office; of the operation of the principle of mutual recognition (by focusing in particular on the European Arrest Warrant System) and its impact on the relationship between mutual trust and fundamental rights; of EU legislation in the field on criminal procedure, including legislation on the rights of the defendant and the victim; of the relationship between EU criminal law and citizenship of the Union; and of the evolution of an EU model of preventive justice, as exemplified by the proliferation of measures on terrorist sanctions.
