In this book, legal scholars outline how and why the Supreme Court should revitalize the nondelegation doctrine—which has not been invoked since 1935. If the Court does so, it will protect the constitutional separation of powers and require Congress to make the difficult political decisions that a legislature should make in a democratic society.

Self Representation written by Jona Goldschmidt and has been published by Rowman & Littlefield this book supported file pdf, txt, epub, kindle and other format this book has been release on 2022-01-14 with Law categories.

Self-representation has a long, venerable history dating to biblical times and continuing through the common law, the colonial era, to the present. This book collects and analyzes the law, ethics opinions, and empirical studies about the wide range of issues surrounding Self-represented litigants (SRLs) in our justice system, including how much, if any, assistance should a judge provide, what duties do lawyers interacting with SRLs, and many others. Using recent empirical studies from both Civil litigation and criminal defense, Jona Goldschmidt argues that SRLs’ cases cannot be fairly heard without a mandatory judicial duty of reasonable assistance. In order to maintain public trust and confidence in our justice system, self-represented parties must be guided and assisted. Courts and the legal profession should continue to adapt and meet the challenge of managing and interacting with those who choose or are compelled to self-represent. Only when self-represented litigants are embraced by the courts, they will finally receive “equal justice under law.” This book would be of interest to those studying criminal justice and legal studies, specifically legal history and legal ethics, as well as judges, lawyers and other professionals in the field.

At its core, administrative law is a process-driven course. Nevertheless, traditional casebooks are organized around legal concepts and doctrines rather than the basic stages of administrative decision-making. This casebook improves on the traditional model by following the major steps in the administrative process, thereby providing students with ample grounding in the law and practice governing it. In addition to featuring seminal administrative law decisions, Administrative Law:A Lifecycle Approachincorporates a variety of agency-oriented materials—government reports, charts, diagrams, orders—that give students a fuller sense of how the administrative state’s organization and operations. These carefully edited materials model how skilled jurists and administrative lawyers go about their work, how legal problems with that work arise, and how administrative, judicial, and political processes have developed to address them. Critically, this casebook also provides numerous opportunities for guided review, synthesis, analysis, and application of salient legal concepts to facilitate student learning. Dozens of questions, as many or more than any other casebook on the market, place students in the position of lawyers tasked with navigating the administrative landscape. Professors and students will benefit from: Emphasis on the lifecycle of the administrative decision-making process to place the legal doctrines typically covered by the administrative law course in a clearer practical context. Cases and other agency-oriented materials that are tightly edited and selected for both seminality and instructive value. Examples of agency work product and descriptions of agency organization and operations that are strategically placed throughout the book. Explanatory introductions to most topics and describes basic and recurring fact patterns that lawyers encounter when dealing with the issues of administrative law and policy. Agency-oriented materials—reports, charts, diagrams, opinions—to give students a fuller, unmediated sense of administrative work product. Questions inspired by Bloom’s Taxonomy that focus instead on testing, reinforcing, and extending students’ understanding of the administrative law and concepts featured throughout the book. Numerous problems that prompt students to apply what they have learned and to produce the types of analysis expected of skilled administrative lawyers.

The Anatomy Of Administrative Law written by Joanna Bell and has been published by Bloomsbury Publishing this book supported file pdf, txt, epub, kindle and other format this book has been release on 2020-05-28 with Law categories.

This book seeks to further our understanding of the nature of administrative law doctrine and adjudication. It has three main aims. The first is to improve understanding of administrative law's 'anatomy' by pulling the subject apart and exploring the nature of the legal structures at play in adjudication. In doing so, the book emphasises three main ways in which administrative law's anatomy is both complex and diverse, namely: - administrative law doctrine interacts with a broad array of legislative frameworks; - administrative law adjudication seeks to accommodate a variety of legal values; and, - administrative law is concerned with legal relationships of different kinds. The second aim is to illustrate the importance of recognising the complexity and variety of administrative law's anatomy in three particular doctrinal contexts: procedural review, legitimate expectations and standing. The third and final aim is to raise an important but under-explored question: is it plausible and useful to attempt to make sense of administrative law doctrine by reference to a singular organising concept or principle? The overarching message of the book is one of cynicism. The complexity and variety of administrative law's legal structures probably means that attempts to explain the field 'monistically', while they may capture important themes, will be unhelpfully reductionist. Ambitious and thought-provoking, this is an important new statement on administrative law.

Democracy S Chief Executive written by Peter M Shane and has been published by Univ of California Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2022-05-10 with Law categories.

Legal scholar Peter M. Shane confronts U.S. presidential entitlement and offers a more reasonable way of conceptualizing our constitutional presidency in the twenty-first century. In the eyes of modern-day presidentialists, the United States Constitution’s vesting of “executive power” means today what it meant in 1787. For them, what it meant in 1787 was the creation of a largely unilateral presidency, and in their view, a unilateral presidency still best serves our national interest. Democracy’s Chief Executive challenges each of these premises, while showing how their influence on constitutional interpretation for more than forty years has set the stage for a presidency ripe for authoritarianism. Democracy’s Chief Executive explains how dogmatic ideas about expansive executive authority can create within the government a psychology of presidential entitlement that threatens American democracy and the rule of law. Tracing today’s aggressive presidentialism to a steady consolidation of White House power aided primarily by right-wing lawyers and judges since 1981, Peter M. Shane argues that this is a dangerously authoritarian form of constitutional interpretation that is not even well supported by an originalist perspective. Offering instead a fresh approach to balancing presidential powers, Shane develops an interpretative model of adaptive constitutionalism, rooted in the values of deliberative democracy. Democracy’s Chief Executive demonstrates that justifying outcomes explicitly based on core democratic values is more, not less, constraining for judicial decision making—and presents a model that Americans across the political spectrum should embrace.

The history of patent harmonization is a story of dynamic actors, whose interactions with established structures shaped the patent regime. From the inception of the trade regime to include intellectual property (IP) rights to the present, this book documents the role of different sets of actors – states, transnational business corporations, or civil society groups – and their influence on the structures – such as national and international agreements, organizations, and private entities – that have caused changes to healthcare and access to medication. Presenting the debates over patents, trade, and the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS Agreement), as it galvanized non-state and nonbusiness actors, the book highlights how an alternative framing and understanding of pharmaceutical patent rights emerged: as a public issue, instead of a trade or IP issue. The book thus offers an important analysis of the legal and political dynamics through which the contest for access to lifesaving medication has been, and will continue to be, fought. In addition to academics working in the areas of international law, development, and public health, this book will also be of interest to policy makers, state actors, and others with relevant concerns working in nongovernmental and international organizations.
