Divorce has long been viewed as a single phenomenon affecting two individuals without considering the framework conditions in which it occurs. Due to the increase of divorce rates in the past decades researchers have changed their perspective and have concentrated on the view of divorce as a personal experience that is greatly affected by the socials and economic environment. The aim of this thesis is to investigate divorce that has become a mass phenomenon in our present society. The assumption is that in order to understand the grounds for divorce and its consequences, we have to view divorce as a phenomenon that occurs at the intersection of personal, socio-economic and legal factors. Family disputes involve persons who have interdependent and continued relati- ships and arise in a context of distressing emotions. Separation and divorce affect all the members of the family, especially children. The study presents a comprehensive analysis of divorce as a psychological process that is situated within a social and a legal context. It presents a comprehensive view of divorce as a psychosocial, economic and legal phenomenon and contains a review of the research literature about divorce and its consequences for parents and children. Moreover, it describes divorce by proposing conceptual frames and explanatory models.

Con el paso de los años, la dinámica familiar ha ido variando influida por diversos factores, entre ellos la incorporación de la mujer al mundo laboral o el progresivo interés de los padres por participar en las tareas de cuidado de sus hijos, dando lugar a que ambos progenitores hayan ido compartiendo las obligaciones de cuidado, educación y asistencia a los menores. Todo ello conlleva que ciertos sectores de la sociedad hayan demandado la incorporación de la custodia compartida en el Código Civil como una modalidad más de guarda y custodia, implicando una participación conjunta de ambos progenitores. Asimismo, muchos progenitores, individualmente, reclaman una situación de igualdad a la hora de adoptar la guarda y custodia de los hijos; en primer lugar, para poder seguir llevando a cabo sus responsabilidades parentales después del cese de la convivencia y, en segundo lugar, para mantener una relación fluida con los menores. Este trabajo pretende ser una cartografía jurídica de la legislación y jurisprudencia sobre la guarda y custodia compartida en España. Presenta las bondades y deficiencias del sistema e intenta aportar diferentes soluciones a la regulación parcial de nuestro Código Civil. Un buen conducto para salvar esta escasez legal es la más nutrida regulación de las CCAA y las aportaciones jurisprudenciales a los conflictos que se generan día a día. Jésica Delgado Sáez. Nacida en Salamanca en 1991. Licenciada en Derecho, Máster en Derecho Privado Patrimonial y Doctora en Derecho Privado con mención internacional por la Universidad de Salamanca. Es abogada en ejercicio e investigadora, siendo su área de estudio el Derecho de familia. Ha realizado las siguientes estancias en Universidades y Centros de Investigación: Universitat de Barcelona (2017), Universidade Do Porto (2018) y Max-Planck-Institut für ausländisches und internationales Privatrecht (2018). Ha participado en Congresos y Conferencias en diferentes Universidades nacionales e internacionales y ha colaborado en publicaciones colectivas como “The right of the child to be heard in proceedings of parental responsabilities” (2019); “Cookies y consentimiento a propósito de la Sentencia del Tribunal de Justicia de la Unión Europea de 1 de octubre de 2019” (2020). El presente libro tiene por objeto el análisis del artículo 23 de la Convención de Nueva York y su reflejo en el Derecho español. Esta norma persigue que las personas con discapacidad ejerciten sus derechos en igualdad de condiciones con las demás personas y para ello prohíbe las consecuencias discriminatorias de la discapacidad en materia familiar. Debe aclararse que este estudio no tiene por objeto analizar en detalle las instituciones que pone en jaque el artículo 23 y que alcanzan a la práctica totalidad del derecho de familia, sino verificar, desde un enfoque de derechos humanos, si su regulación se adecúa a los dictados del texto internacional y, si no es así, realizar propuestas de reforma que acomoden nuestro Derecho de familia a los postulados de la Convención, incluyéndose las referencias oportunas al Derecho comparado que resultan, sin duda, imprescindibles en un trabajo de esta naturaleza.

El régimen jurídico de la filiación probablemente sea, dentro del Derecho civil, el que mayores y más profundos cambios ha experimentado en los años que llevamos contabilizados del siglo XXI. Ello, dentro de un Derecho de familia que, como advierte el profesor Durán Rivacoba, prologuista de esta monografía, ha dejado de ser en notable medida esa esfera en la que el orden público se hallaba siempre presente. Fruto de todo ello, el juego de la presunción de paternidad matrimonial o la revisión por la jurisprudencia del Tribunal Constitucional del régimen de las acciones de impugnación de la filiación han hecho necesario un nuevo estudio del régimen en su conjunto. De un lado, la adopción y el derecho a conocer la paternidad biológica por parte de los adoptados se presenta como imperativo que contrastaba con el derecho de la madre en riesgo de exclusión social, hasta que el Tribunal Supremo decidiera en 1999 que semejante derecho a ser desconocida es contrario a la Constitución, pues parece que tal imperativo de acceder a la verdad biológica no tiene límites. O que solo ha de tener los límites que parecen imponer los profesionales de las técnicas de reproducción asistida, que convencían en el mismo año al Tribunal Constitucional de que los nacidos solamente pueden conocer la identidad del donante de esperma que permitió su concepción cuando existan razones eugenésicas, pero no en circunstancias normales. No sea que las donaciones caigan en número hasta cifras que no permitan la rentabilidad de la industria? Añádase a ello la dimensión que desde un punto de vista teórico y práctico está llamada a tener el matrimonio compuesto por personas del mismo sexo. Desde la posibilidad de determinación de la filiación a favor de la esposa de la gestante por la simple manifestación de aquélla (2007), hasta la de que dos varones consigan inscribir en el Registro español al hijo que lograron gracias a una maternidad subrogada que, prohibida en España, se encuentre permitida en otro país (2009). La verdad biológica en la determinación de la filiación constituye, en fin, un tema de dimensiones muy notables en el nuevo marco globalizado del Derecho de familia, y un título sugestivo en la Colección Persona y Familia de este sello editorial, obra de la profesora peruana Maricela Gonzales, quien, docente en la Universidad de Piura, es doctora por la Universidad de Oviedo y experta en la materia.
