Comparative legal studies can be defined as the purposeful analysis of different laws or legal systems through the use of one or more approaches. Comparative law consists of the fields ‘private international law’, ‘the making of law’, ‘the interpretation and application of the law’, ‘the confluence of the law and the development of general common principles’ and ‘the unification of the law’ . The aim of this essay is to explain these five basic fields in which comparative legal studies are employed and to illustrate these subjects by giving examples.

This book, which is dedicated to the memory of distinguished scholar Professor Simon Roberts, is a collection of essays exploring themes and issues in the relationship between comparative legal studies and other disciplines in the social sciences and humanities. Law does not exist in a vacuum, and an appreciation of the social, cultural and other factors affecting it may often be helpful for a sounder understanding of its nature and significance, especially when law is considered in a broader, comparative, context. Insights drawn from other disciplines may therefore be especially appropriate for comparative legal studies, but the use of those insights raises various questions, such as the manner in which other disciplines--given their own distinctive concerns and modes of analysis--characterise the nature and significance of law and legal institutions. Interdisciplinary study also encourages us to ask how cognate disciplines and their arguments are seen, used and maltreated in comparative legal studies, as well as the pitfalls which await scholars from other disciplines who venture into law. The essays in this collection offer a unique contribution to these and other aspects of the use of interdisciplinarity in comparative law. This short book on comparative law theory and method is designed primarily for postgraduate research students whose work involves comparison between legal systems. It is, accordingly, a book on research methods, although it will also be of relevance to all students (undergraduate and postgraduate) taking courses in comparative law and to academics entering the field of comparison. The substance of the book has been developed over many years of teaching general theory of comparative law, primarily on the European Academy of Legal Theory programme in Brussels but also on other programmes in French, Belgian and English universities. It is arguable that there has been to date no single introductory work exclusively devoted to comparative law methodology and thus this present book aims to fill this gap.
