The 14 essays that make up this 2003 volume are written by leading international scholars to provide an authoritative survey of the state of comparative legal studies. Representing such varied disciplines as the law, political science, sociology, history and anthropology, the contributors review the intellectual traditions that have evolved within the discipline of comparative legal studies, explore the strengths and failings of the various methodologies that comparatists adopt and, significantly, explore the directions that the subject is likely to take in the future. No previous work had examined so comprehensively the philosophical and methodological foundations of comparative law. This is quite simply a book with which anyone embarking on comparative legal studies will have to engage.

Essay from the year 2016 in the subject Law - Comparative Legal Systems, Comparative Law, grade: 78%, 17 Punkte, University of Hull, language: English, abstract: In times of globalization and internationalisation comparative legal studies play an ever more important role. Especially against the backdrop of trying to foster understanding of different cultures as well as to enhance the development of domestic legal systems and thereby improve one’s own law , comparative law studies are becoming increasingly significant. Comparative legal studies can be defined as the purposeful analysis of different laws or legal systems through the use of one or more approaches. Comparative law consists of the fields ‘private international law’, ‘the making of law’, ‘the interpretation and application of the law’, ‘the confluence of the law and the development of general common principles’ and ‘the unification of the law’ . The aim of this essay is to explain these five basic fields in which comparative legal studies are employed and to illustrate these subjects by giving examples.

This book, which is dedicated to the memory of distinguished scholar Professor Simon Roberts, is a collection of essays exploring themes and issues in the relationship between comparative legal studies and other disciplines in the social sciences and humanities. Law does not exist in a vacuum, and an appreciation of the social, cultural and other factors affecting it may often be helpful for a sounder understanding of its nature and significance, especially when law is considered in a broader, comparative, context. Insights drawn from other disciplines may therefore be especially appropriate for comparative legal studies, but the use of those insights raises various questions, such as the manner in which other disciplines--given their own distinctive concerns and modes of analysis--characterise the nature and significance of law and legal institutions. Interdisciplinary study also encourages us to ask how cognate disciplines and their arguments are seen, used and maltreated in comparative legal studies, as well as the pitfalls which await scholars from other disciplines who venture into law. The essays in this collection offer a unique contribution to these and other aspects of the use of interdisciplinarity in comparative law. The contributors cover a broad range of disciplines and topics. Nicholas Foster, Maria Federica Moscati and Michael Palmer offer some general observations; Eric Heinze examines basic theoretical problems of comparative law by analogy to a comparative literary model; Jaakko Husa considers the nature and problems of 'Interdisciplinary Comparative Law'; Dionysia Katelouzou explores the value of quantitative methods drawn from the fields of economics and finance; Karen McAuliffe examines issues of law, language and translation; Fernanda Pirie considers the significance of historical studies for anthropological understandings of non-state law; Marian Roberts examines the influences of interdisciplinarity on the development and practice of UK family mediation; Mathias Siems speaks to the use in comparative legal studies of insights drawn from other comparative disciplines; Florian Wagner-von Papp explores issues in the relationship between comparative law and economics, while Gary Watt contrasts economics-based interdisciplinarity to the humanities approach; Simon Roberts draws on anthropological approaches to negotiation for understanding civil justice issues; and Sir Ross Cranston reflects on the value of an important area of Simon Roberts' interdisciplinary work.

What does doing comparative law involve? Too often, explicit methodological discussions in comparative law remain limited to the level of pure theory, neglecting to test out critiques and recommendations on concrete issues. This book bridges this gap between theory and practice in comparative legal studies. Essays by both established and younger comparative lawyers reflect on the methodological challenges arising in their own work and in work in their area. Taken together, they offer clear recommendations for, and critical reflection on, a wide range of innovative comparative research projects.

Comparative Law As Critique written by Günter Frankenberg and has been published by Edward Elgar Publishing this book supported file pdf, txt, epub, kindle and other format this book has been release on 2016-04-29 with Law categories.

Presenting a critique of conventional methods in comparative law, this book argues that, for comparative law to qualify as a discipline, comparatists must reflect on how and why they make comparisons. Günter Frankenberg discusses not only methods and theories, but also the ethical implications and the politics of comparative law in bringing out the different dimensions of the discipline. Comparative Law as Critique offers various approaches that turn against the academic discourse of comparative law, including analysis of a widespread spirit of innocence in terms of method, and critique of human rights narratives. It also examines how courts negotiate differences between cases regarding Muslim veiling. The incisive critiques and comparisons in this book will be of essential reading for comparatists working in legal education and research, as well as students of comparative law and scholars in comparative anthropology and social sciences.

The book examines nine countries on three continents, bringing together academic views and educational insights from ten scholars in the field of comparative law.

An Introduction To Comparative Law Theory And Method written by Geoffrey Samuel and has been published by Bloomsbury Publishing this book supported file pdf, txt, epub, kindle and other format this book has been release on 2014-12-01 with Law categories.

This short book on comparative law theory and method is designed primarily for postgraduate research students whose work involves comparison between legal systems. It is, accordingly, a book on research methods, although it will also be of relevance to all students (undergraduate and postgraduate) taking courses in comparative law and to academics entering the field of comparison. The substance of the book has been developed over many years of teaching general theory of comparative law, primarily on the European Academy of Legal Theory programme in Brussels but also on other programmes in French, Belgian and English universities. It is arguable that there has been to date no single introductory work exclusively devoted to comparative law methodology and thus this present book aims to fill this gap.
