El presente libro tiene por objeto el estudio del régimen jurídico del terrorismo, prestando particular atención a las principales resoluciones que han dictado tribunales supremos significativos, en relación con dicho fenómeno, y más concretamente las dictadas tras los atentados de 11 de septiembre de 2001. En una primera parte se alude a las transformaciones legislativas que ha comportado la lucha contra el terrorismo, que pueden sintetizarse en lo que los constitucionalistas han descrito como una normalización del Derecho excepcional o los penalistas han estudiado dentro de la rúbrica «Derecho penal del enemigo». En una segunda parte se analizan las principales sentencias recaídas sobre la materia con particular referencia, al menos, a cinco Sentencias del Tribunal Supremo de EE UU (tres de 28 de junio de 2004 -Rasul v. Bush, Hamdi v. Rumsfeld, y Padilla v. Rumsfeld-, otra de 29 de junio de 2006 -Hamdan v. Rumsfeld- y otra de 12 de junio de 2008 -Boumediene vs. Bush-). La última parte del libro resume las reflexiones que suscita el estudio de este acervo legislativo y jurisprudencial. Son, entre otras, las siguientes: 1. Ninguno de los tres paradigmas clásicos para afrontar la violencia ilegítima, esto es, el Derecho penal, el Derecho de la guerra y el Derecho de excepción, sirven plenamente para hacer frente al terrorismo. Es preciso configurar el llamado estado de tensión. 2. Es conveniente un anclaje constitucional bien del estado de tensión, bien de la legislación especial, anclaje que existe en nuestra Constitución vigente. 3. Punto irrenunciable del nuevo Derecho de emergencia es el principio de universalidad de los derechos humanos. 4. El acervo jurisprudencial del TEDH constituye el punto de partida más adecuado para la construcción del nuevo Derecho de emergencia. 5. La Sentencia del Tribunal Supremo de Estados Unidos en el caso Buomediene y el posterior acceso a la Presidencia de Barack Obama pueden marcar un punto a partir del cual el régimen jurídico del terrorismo en Estados Unidos no siga distanciándose del régimen europeo, de modo que se empiece a caminar en ambos lados del Atlántico en direcciones convergentes.

Los estudios contenidos en la presente monografía abordan desde una perspectiva interdisciplinar y comparada el impacto que está teniendo el terrorismo en los Estados democráticos, haciendo especial hincapié en las dificultades que se observan para lograr el necesario equilibrio entre dos categorías que se contraponen: libertad y seguridad. Algunas de las cuestiones que esta pugna recurrente suscita son: el carácter prevalente que se otorga a la seguridad como elemento para limitar o restringir el ejercicio de los derechos fundamentales, y justificar la adopción de una determinada política legislativa por los Estados; la evolución que han experimentado las medidas adoptadas por las instituciones de la UE ante una amenaza terrorista cambiante; la situación que presentan los menores extranjeros en los Estados de la UE, y su difícil encaje entre las políticas de contención de la inmigración irregular y las políticas de protección a la infancia extranjera; la eventual suspensión del CEDH en España como consecuencia de un ataque terrorista; la adopción de una política legislativa en nombre de la seguridad, que persigue realmente la restricción de la libertad religiosa en Rusia; la simbiosis que se ha consolidado entre el terrorismo y los medios de comunicación, y su papel en la construcción de una imagen estereotipada del Islam; y la relación que se observa entre el origen del terrorismo yihadista, los episodios de odio religioso, la discriminación por motivos religiosos, y el tipo de protección que los ordenamientos occidentales actuales otorgan a la conciencia. El tema desarrollado reviste especial interés porque la transformación que ha experimentado el terrorismo, de amenaza local a fenómeno global, constituye el principal problema de seguridad que comparten en la actualidad todos los gobiernos occidentales. Y para afrontarlo, la política legislativa de los Estados tiende a implantar mecanismos limitativos de los derechos de sus ciudadanos con un doble objetivo: preservar la seguridad, y atender la creciente demanda social que exige una mayor capacidad preventiva a los poderes públicos. No se discute que la adopción de estas medidas preventivas o represivas sea necesaria en una sociedad democrática, pero si se recuerda que su encaje debe producirse, siempre, desde el respeto a los derechos fundamentales.

In any country where there is a Bill of Rights, constitutional rights reasoning is an important part of the legal process. As more and more countries adopt Human Rights legislation and accede to international human rights agreements, and as the European Union introduces its own Bill of Rights, judges struggle to implement these rights consistently and sometimes the reasoning behind them is lost. This is a revised and extensively rewritten edition of one of the most influential monographs on legal philosophy published in recent years. Writing in the introduction to the first edition the author characterized Anglophone philosophers as being ..."divided, and often waver[ing] between two main philosophical objectives: the moral evaluation of law and legal institutions, and an account of its actual nature." Questions of methodology have therefore tended to be sidelined, but were bound to surface sooner or later, as they have in the later work of Ronald Dworkin. The main purpose of this book is to provide a critical assessment of Dworkin's methodological turn, away from analytical jurisprudence towards a theory of interpretation, and the issues it gives rise to. The author argues that the importance of Dworkin's interpretative turn is not that it provides a substitute for 'semantic theories of law' (a dubious concept), but that it provides a new conception of jurisprudence, aiming to present itself as a comprehensive rival to the conventionalism manifest in legal positivism. Furthermore, once the interpretative turn is regarded as an overall challenge to conventionalism, it is easier to see why it does not confine itself to a critique of method. Law as interpretation calls into question the main tenets of its positivist rival, in substance as well as method. The book re-examines conventionalism in the light of this interpretative challenge.

When people disagree about justice and about individual rights, how should political decisions be made among them? How should they decide about issues like tax policy, welfare provision, criminal procedure, discrimination law, hate speech, pornography, political dissent and the limits of religious toleration? The most familiar answer is that these decisions should be made democratically, by majority voting among the people or their representatives. Often, however, this answer is qualified by adding ' providing that the majority decision does not violate individual rights.' In this book Jeremy Waldron has revisited and thoroughly revised thirteen of his most recent essays. He argues that the familiar answer is correct, but that the qualification about individual rights is incoherent. If rights are the very things we disagree about, then we are quarrelling precisely about what that qualification should amount to. At best, what it means is that disagreements about rights should be resolved by some other procedure, for example, by majority voting, not among the people or their representatives, but among judges in a court. This proposal - although initially attractive - seems much less agreeable when we consider that the judges too disagree about rights, and they disagree about them along exactly the same lines as the citizens. This book offers a comprehensive critique of the idea of the judicial review of legislation. The author argues that a belief in rights is not the same as a commitment to a Bill of Rights. He shows the flaws and difficulties in many common defences of the 'democratic' character of judicial review. And he argues for an alternative approach to the problem of disagreement: when disagreements about rights arise, the respectful way to resolve them is by decision-making among the right-holders on a basis that reflects an equal respect for them as the holders of views about rights. This respect for ordinary right-holders, he argues, has been sadly lacking in the theories of justice, rights, and constitutionalism put forward in recent years by philosophers such as John Rawls and Donald Dworkin. But the book is not only about judicial review. The first tranche of essays is devoted to a theory of legislation, a theory which highlights the size, the scale and the diversity of modern legislative assemblies. Although legislation is often denigrated as a source of law, Waldron seeks to restore its tattered dignity. He deprecates the tendency to disparage legislatures and argues that such disparagement is often a way of bolstering the legitimacy of the courts, as if we had to transform our parliaments into something like the American Congress to justify importing American-style judicial reviews. Law and Disagreement redresses the balances in modern jurisprudence. It presents legislation by a representative assembly as a form of law making which is especially apt for a society whose members disagree with one another about fundamental issues of principle, for it is a form of law making that does not attempt to conceal the fact that our decisions are made and claim their authority in the midst of, not in spite of, our political and moral disagreements. This timely rights-based defence of majoritarian legislation will be welcomed by scholars of legal and political philosophy throughout the world.
