Aunque la influencia de las constituciones francesa e inglesa en la Constitución de Cádiz de 1812 ha sido ampliamente estudiada, resultan menos conocidas sus conexiones con la Constitución de Estados Unidos de 1787, aún vigente. El propósito de este libro no es calibrar la influencia de la Constitución norteamericana sobre la española, sino evaluar sus similitudes y diferencias a la luz de los principios liberales derivados de la Ilustración, desde los que se promovió la independencia de Norteamérica y el fin del absolutismo en España. A pesar de que ninguna de las dos promulgaba la soberanía universal y hubieron de hacer frente al encaje constitucional de la esclavitud, en el caso de Estados Unidos, y de las “castas pardas”, en el español, sus principios, relativos a la separación y limitación de poderes, la igualdad ante la ley, las libertades individuales, la soberanía nacional y la supremacía de la Constitución sobre cualquier otro poder, siguen constituyendo los fundamentos de las actuales sociedades democráticas. Su autor ofrece un pormenorizado y riguroso análisis tanto de los aspectos filosóficos e ideológicos que fundamentaron dichas constituciones como del contexto sociohistórico del que surgieron, condicionando su desigual fortuna.
