This book presents an extensive study on the extant constructs of corruption in infrastructure-related projects and aims to contribute to the determination and elimination of its incidence and prevalence in infrastructure projects. The book conducts a comprehensive examination of the various determining factors of corruption that negatively affect the procurement process and, in the end, result in cost and time overruns. The authors present an in-depth understanding of how the identified determining factors of corruption can be addressed. Thus, it is intended to broaden the reader's knowledge of the causes, risk indicators, and different forms of corrupt practices in the procurement process of infrastructure works, before explaining how they affect its stages and activities A dynamic model is developed to demonstrate how to tackle the overall impact of corruption within the procurement process and, at the same time, increase the effectiveness of the extant anti-corruption measures. In short, this book demonstrates that the fight against corruption in the procurement process is strategically feasible and must continue. This book is essential reading for academics, researchers, professionals and stakeholders in the procurement of infrastructure projects and civil works, as well as those with an interest in corruption, construction management and construction project management.

Recognising the significant number of procurement fraud and corruption risks that can impact an organisation - including roles and people who have the potential to influence or manipulate projects and the procurement life cycle that might include a lack of trained personnel, procurement and financial controls, and compliance measures in place - can undermine the design and implementation of an anti-corruption and counter procurement fraud approach. Since procurement fraud and corruption continue to develop in scope, scale and creativity, the risks, typologies and routes to mitigation should be regarded as part of a constantly assessed and updated approach. Creating an anti-corruption and counter procurement fraud approach should provide an awareness of the criminal risks within an organisation's procurement and associated processes and reinforce the importance and vital role of leadership, ethics professionals, staff and other stakeholders in building an anti-corruption culture to protect organisational revenues and reputation. The 4-pillar framework approach to counter procurement fraud contains 16 steps to identify and prevent corruption and procurement fraud risk. It examines how a risk mitigation framework created with a foundation of education, data collection, risk assessment and a coordinated response and change management process can help identify and mitigate risk. Planning and following this approach one step at a time, collecting all available data, will assist in assessing the challenges and performance measurement in each area and help create a strategic response to identified risk.

Combatting Corruption And Collusion In Public Procurement written by Robert D. Anderson and has been published by Oxford University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2024-03-06 with Law categories.

'Corruption' in public procurement typically involves procurement decisions taken in favour of preferred bidders in exchange for improper compensation (the acceptance of bribes, for example), while supplier collusion refers to a type of cartel activity, in which firms rig their bids in a tendering process. Although these practices are distinct, they frequently occur together in the public procurement context, reinforcing one another. Combatting Corruption and Collusion in Public Procurement: A Challenge for Governments Worldwide examines the causes of corruption and collusion in the public procurement sphere, its resulting harm, and how states can best try to combat these practices. This book provides a legal, economic, and practical analysis of issues concerning corruption and supplier collusion in public procurement, both generally and in seven diverse and representative jurisdictions: the United Kingdom, the United States, Brazil, Hungary and Poland, Ukraine, and Canada. It encompasses a discussion of both 'generic' cross-jurisdictional issues and specific proposals for individual jurisdictions. It offers practical guidance on building robust regimes for combatting corruption and collusion in public procurement and how to bolster and improve them when they are faltering. The book stresses the need for a multi-faceted and joined-up approach to the problems, emphasizing the importance both of enhanced investment in the effective enforcement of anti-corruption and cartel laws and of increasing the resilience of public procurement systems to corruption and collusion through a range of measures. The relevance of the topic to the social and economic well-being of citizens and the survival of democratic governance is highlighted throughout the book. Pioneering and comprehensive, Combatting Corruption and Collusion in Public Procurement provides a pathbreaking analysis of a range of global issues, making it an essential read for scholars, lawyers, government officials and representatives of international and non-governmental organizations around the world.

The Routledge Handbook of Public Procurement Corruption showcases the most innovative and exciting research being conducted in this important area of study, providing a comprehensive go-to reference for all who are interested in the topic. During the COVID-19 pandemic, the global race for health and ancillary goods amid global supply chain disruptions demonstrated that, when tested, all countries are incredibly vulnerable to fraud and corruption in public procurement, irrespective of their level of development. Yet despite the widespread nature of the problem, there remains a lack of in-depth, analytical, and cross-country investigations into public procurement corruption. This book addresses this gap by providing a comprehensive, multidisciplinary, geographically balanced treatise on corruption in public procurement. It combines country-specific studies to allow readers to easily compare differing perspectives and approaches and overarching thematic chapters to reflect on new and cutting-edge issues in procurement and their implications for procurement corruption. Key sectors such as healthcare and infrastructure are considered, as well as the role of new technologies, in both combatting and enabling procurement corruption. This Handbook provides academics, practitioners, and graduate researchers of public administration, law, and anti-corruption with all of the tools they need to understand the nuances of public procurement corruption around the world.

Master's Thesis from the year 2018 in the subject Economics - International Economic Relations, grade: 1,0, Wiesbaden University of Applied Sciences, language: English, abstract: Corruption erodes the functioning of a state's essential organs, meaning its political, economic and social structures, and causes its norms and values to deteriorate, but more severely, it ultimately weakens the heart of good governance - the most feared enemy of corruption. Weakened by this disease, the state, however powerful its systems, becomes more vulnerable and exposed to a great variety of risk factors while the malicious disease increasingly thrives, spreading through the organism and capturing the state, trapping it in a vicious circle. There is no country that is immune to this disease. Whether on the local, national or international stage, corruption wreaks its destructive work at all political, economic and social levels. Public procurement embodies a large, if not the largest part of national economies. Every year, trillions of dollars are deployed for the acquisition of goods, services and works, ranging from those intended to serve basic needs such as education or public health services to those destined for giant infrastructure projects; the latters', large budgets make them tempting targets for corruption, which is often shielded behind the complicated and opaque procurement process. This results in wasteful spending, transforming public procurement, a powerful instrument for the promotion of prosperous economic development, into a harmful growth inhibitor. Public procurement belongs to the group of government activities that are worst affected by corruption. Corruption, seen as a key governance challenge, puts a detrimental strain on the functioning of a sound public procurement system. A public procurement system affected by corruption suffers from a wide range of symptoms; for instance, the quality of public projects may be reduced and public funds may be diverte

Effective Corruption Control written by Annika Engelbert and has been published by Logos Verlag Berlin GmbH this book supported file pdf, txt, epub, kindle and other format this book has been release on 2016-05-16 with Law categories.

This book presents the results of a three-year research project based at the Ruhr-University Bochum, financed by the Fritz Thyssen Foundation, Cologne. Corruption in public procurement is widespread and particularly damaging to development objectives, as it undermines any state's duty to maximize the social and economic welfare of its citizens. Yet, research on country-specific regulation meant to address this problem has remained scarce. This book aims to fill this gap by providing a systematic comparative analysis of supplier remedies mechanisms in Kenya, Uganda and Tanzania. It elaborates on the potential of legal remedies to serve as anticorruption tools. Based on the fact that the anti-corruption effect of remedies mechanisms depends ultimately on the actual use by suppliers, three main factors are discussed: (1) the institutional setting and independence of the remedies systems; (2) their accessibility for aggrieved bidders; and (3) their efficiency, driven by bidder's cost-benefit analysis and including the aspects of procedural fees, duration, available relief and prospects of success. The assessment of the legislation is complemented by information gained from various stakeholders such as public procurement authorities, development organizations, NGOs and scientific experts. Despite many similarities of the systems due to their common historical background, the analysis identifies remarkably different regulative and institutional approaches, and discusses their more or less supportive effects on the use of supplier remedies mechanisms.
