This book traces the evolution of environmental principles from their origins as vague political slogans reflecting fears about environmental hazards to their embodiment in enforceable laws. Environmental law has always responded to risks posed by industrial society but the new generation of risks have required a new set of environmental principles, emerging from a combination of public fears, science, ethics, and established legal practice. This book shows how three of the most important principles of modern environmental law grew out of this new age of ecological risk: the polluter pays principle, the preventive principle, and the precautionary principle. Since the first edition was published, the principles of polluter-pays, prevention, and precaution have been encapsulated in a swathe of legislation at domestic and international level. Courts have been invoking environmental law principles in a broad range of cases, on issues including GMOs, conservation, investment, waste, and climate change. As a result, more States are paying heed to these principles as catalysts for improving their environmental laws and regulations. This edition will integrate to a greater extent the relationship between environmental principles and human rights. The book analyses new developments including the EU Charter of Fundamental Rights, the case law of the European Court of Human Rights, which has continuously carved out environmental duties from a number of rights enshrined in the European Convention of Human Rights, and the implementation of the UNECE Convention on Access to Information.

This book analyses the contribution of Eugen (Jenő) Varga (1879-1964) on Marxist-Leninist economic theory as well as the influence he exercised on Stalin’s foreign policy and through the Comintern on the international communist movement. During the Hungarian Councils’ Republic of 1919 Varga was one of those chiefly responsible for transforming the economy into one big industrial and agrarian firm under state authority. After the fall of the revolutionary regime that year, Varga joined the Hungarian Communist Party, soon after which, he would become one of the Comintern’s leading economists, predicting the inevitable crisis of the capitalist system. Varga became the Soviet Union’s official propagandist. As an economic specialist he would advise the Soviet government on German reparation payments and, unlike Stalin, believed that the capitalist state would be able to plan post-war economic recovery, which contradicted Stalin’s foreign policy strategy and led to his disgrace. Thus by the beginning of the Cold War in 1947, Varga was discredited, but allowed to keep a minor academic position. After Stalin’s death in 1953 he reappeared as a well-respected economist whose political influence had nonetheless waned. In this study Mommen reveals how Stalin’s view on international capitalism and inter-imperialist rivalries was profoundly influenced by debates in the Comintern and by Varga’s concept of the general crisis of capitalism. Though Stalin appreciated Varga’s cleverness, he never trusted him when making his strategic foreign policy decisions. This was clearly demonstrated in August 1939 with Stalin’s pact with Hitler, and in 1947, with his refusal to participate in Marshall’s European Recovery Plan. This book should be of interest to a wide variety of students and researchers, including those concentrating on the history of economic thought, Soviet studies, international relations, and European and Cold War history.

Red Saxony throws new light on the reciprocal relationship between political modernization and authoritarianism in Germany over the span of six decades. Election battles were fought so fiercely in Imperial Germany because they reflected two kinds of democratization. Social democratization could not be stopped, but political democratization was opposed by many members of the German bourgeoisie. Frightened by the electoral success of the Social Democrats after 1871, anti-democrats deployed many strategies that flew in the face of electoral fairness. They battled socialists, liberals, and Jews at election time, but they also strove to rewrite the electoral rules of the game. Using a regional lens to rethink older assumptions about Germany's changing political culture, this volume focuses as much on contemporary Germans' perceptions of electoral fairness as on their experiences of voting. It devotes special attention to various semi-democratic voting systems whereby a general and equal suffrage (for the Reichstag) was combined with limited and unequal ones for local and regional parliaments. For the first time, democratization at all three tiers of governance and their reciprocal effects are considered together. Although the bourgeois face of German authoritarianism was nowhere more evident than in the Kingdom of Saxony, Red Saxony illustrates how other Germans grew to fear the spectre of democracy. Certainly twists and turns lay ahead, yet that fear made it easier for Hitler and the Nazis to win elections in the 1920s and to entomb German democracy in 1933.

This important book examines the challenges posed to public service obligations by European Union media law and policy. An in-depth analysis of the extent to which six countries (France, Germany, Greece, Italy, the Netherlands, and the United Kingdom) regulate broadcasting for the public interest reveals a range of vulnerability to national political pressures or, alternatively, to the ideology of market sovereignty.
