The divide between “analytic” and “continental” philosophy has occupied a central place in the meta-philosophical discourse of the 20th and 21st century. This volume collects contributions from leading philosophers whose work is in some way impacted by the divide. While some of them tackle the issue in a straightforward manner, others focus on concrete problems in relation to which meta-philosophical differences actually do matter.

Recrafting The Rule Of Law written by David Dyzenhaus and has been published by Bloomsbury Publishing this book supported file pdf, txt, epub, kindle and other format this book has been release on 1999-07-01 with Law categories.

This collection of essays on the rule of law focuses on the traditional question whether the rule of law is necessarily the rule of moral principles, the question of the legitimacy of law. Essays by lawyers, philosophers, and political theorists illuminate and take forward both that question and debate about issues to do with the reach of the rule of law which complicate its answer. The essays are divided into sections which deal, first, with legal orders where the rule of law is under severe stress, second, with the question of the value of the rule of law as a conceptual problem, and, third, with the question of the limits of legal order. Sociological Jurisprudence written by Roger Cotterrell and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2017-12-06 with Law categories.

This book presents a unified set of arguments about the nature of jurisprudence and its relation to the jurist’s role. It explores contemporary challenges that create a need for social scientific perspectives in jurisprudence, and it shows how sociological resources can and should be used in considering juristic issues. Its overall aim is to redefine the concept of sociological jurisprudence and outline a new agenda for this. Supporting this agenda, the book elaborates a distinctive juristic perspective that recognises law’s diversity of cultural meanings, its extending transnational reach, its responsibilities to reflect popular aspirations for justice and security, and its integrative tasks as a general resource of regulation for society as a whole and for the individuals who interact under law’s protection. Drawing on and extending the author’s previous work, the book will be essential reading for students, researchers and academics working in jurisprudence, law and society, socio-legal studies, sociology of law, and comparative legal studies.

Finding One S Way Through Wittgenstein S Philosophical Investigations written by Emmanuel Bermon and has been published by Springer this book supported file pdf, txt, epub, kindle and other format this book has been release on 2017-10-20 with Philosophy categories.

This volume sheds a new light on Philosophical Investigations, Ludwig Wittgenstein’s master opus, by taking a new approach to its first stretch (sections §§1-88), with special emphasis on its atypical opening. The methodological conviction that subtends the volume is that the highly unconventional form assumed by the book is internal to its content and crucial to its reconception of the relation between logic and language. This disconcerting form is dictated by the new modes of criticism deployed by Wittgenstein as he engages the philosophical tradition in the new terms afforded by the revolutionary “method of language-games”. In the essays collected here, seven authors, including some of the most influential figures in the field, offer close and often unorthodox readings of pivotal passages from the beginning of the book. These readings are also shaped by the conviction that the Philosophical Investigations are hardly intelligible apart from an appreciation of the concerns that they inherit from Wittgenstein’s early work, the Tractatus Logico-Philosophicus. The authors contend that we need to consider the continuities between the early and the later works if we are to disclose the true discontinuities between them.

A Critical Appraisal Of Karl Olivecrona S Legal Philosophy written by Torben Spaak and has been published by Springer this book supported file pdf, txt, epub, kindle and other format this book has been release on 2014-06-17 with Law categories.

This book offers a critical appraisal of Karl Olivecrona’s legal philosophy. Based on Olivecrona’s critique of the view that law has binding force, the analysis of the concept and function of a legal rule, and the idea that law is a matter of organized force, the book argues that Olivecrona’s legal philosophy is a unique contribution to twentieth century legal philosophy. It shows how Olivecrona’s philosophy can be used in the assessment of contemporary theories of law, such as those put forward by Hart, Raz, Dworkin, and Alexy. In addition, the book argues that Olivecrona’s various discussions of theories defended by key people in the history of legal and political philosophy are highly interesting contributions. They not only increase our understanding of the legal and political philosophy of previous generations, but also enhances our insight into legal-philosophical questions that remain with us today.

Wittgenstein S Thought In Transition written by Dale Jacquette and has been published by this book supported file pdf, txt, epub, kindle and other format this book has been release on 1998 with categories.

Wittgenstein's Thought in Transition offers a detailed exposition of Wittgenstein's philosophy as a continuous engagement with a single set of problems. Dale Jacquette argues that the key to understanding the transition in Wittgenstein's thought is his 1929 essay "Some Remarks on Logical Form," which is reprinted in this book. Wittgenstein disowned the essay, then came to see its failure as refuting his early theory altogether and began to investigate the requirements of meaning with a new method that resulted in the characteristic innovations of his later period.

Between Authority And Interpretation written by Joseph Raz and has been published by OUP Oxford this book supported file pdf, txt, epub, kindle and other format this book has been release on 2009-02-19 with Philosophy categories.

In this book Joseph Raz develops his views on some of the central questions in practical philosophy: legal, political, and moral. The book provides an overview of Raz's work on jurisprudence and the nature of law in the context of broader questions in the philosophy of practical reason. The book opens with a discussion of methodological issues, focusing on understanding the nature of jurisprudence. It asks how the nature of law can be explained, and how the success of a legal theory can be established. The book then addresses central questions on the nature of law, its relation to morality, the nature and justification of authority, and the nature of legal reasoning. It explains how legitimate law, while being a branch of applied morality, is also a relatively autonomous system, which has the potential to bridge moral differences among its subjects. Raz offers responses to some critical reactions to his theory of authority, adumbrating, and modifying the theory to meet some of them. The final part of the book brings together for the first time Raz's work on the nature of interpretation in law and the humanities. It includes a new essay explaining interpretive pluralism and the possibility of interpretive innovation. Taken together, the essays in the volume offer a valuable introduction for students coming for the first time to Raz's work in the philosophy of law, and an original contribution to many of the current debates in practical philosophy.
