The Oxford Handbook of Carl Schmitt collects thirty original chapters on the diverse oeuvre of one of the most controversial thinkers of the twentieth century. Carl Schmitt (1888-1985) was a German theorist whose anti-liberalism continues to inspire scholars and practitioners on both the Left and the Right. Despite Schmitt's rabid anti-semitism and partisan legal practice in Nazi Germany, the appeal of his trenchant critiques of, among other things, aestheticism, representative democracy, and international law as well as of his theoretical justifications of dictatorship and rule by exception is undiminished. Uniquely located at the intersection of law, the social sciences, and the humanities, this volume brings together sophisticated yet accessible interpretations of Schmitt's sprawling thought and complicated biography. The contributors hail from diverse disciplines, including art, law, literature, philosophy, political science, and history. In addition to opening up exciting new avenues of research, The Oxford Handbook of Carl Schmitt provides the intellectual foundations for an improved understanding of the political, legal, and cultural thought of this most infamous of German theorists. A substantial introduction places the trinity of Schmitt's thought in a broad context.

When Germany was defeated in 1945, both the Russians and the Americans undertook mass internments in the territories they occupied. The Americans called their approach “automatic arrest.” Carl Schmitt, although not belonging in the circles subject to automatic arrest, was held in one of these camps in the years 1945–6 and then, in March 1947, in the prison of the international tribunal in Nuremberg, as witness and “possible defendant.” A formal charge was never brought against him. Schmitt’s way of coping throughout the years of isolation was to write this book. In Ex Captivitate Salus, or Deliverance from Captivity, Schmitt considers a range of issues relating to history and political theory as well as recent events, including the Nazi defeat and the newly emerging Cold War. Schmitt often urged his readers to view the book as though it were a series of letters personally directed to each one of them. Hence there is a decidedly personal dimension to the text, as Schmitt expresses his thoughts on his own career trajectory with some pathos, while at the same time emphasising that “this is not romantic or heroic prison literature.” This reflective work sheds new light on Schmitt’s thought and personal situation at the beginning of a period of exile from public life that only ended with his death in 1985. It will be of great value to the many students and scholars in political theory and law who continue to study and appreciate this seminal theorist of the twentieth century.

From Apology To Utopia written by Martti Koskenniemi and has been published by Cambridge University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2006-02-02 with Law categories.

This book presents a critical view of international law as an argumentative practice that aims to 'depoliticise' international relations. Drawing from a range of materials, Koskenniemi demonstrates how international law becomes vulnerable to the contrasting criticisms of being either an irrelevant moralist Utopia or a manipulable façade for State interests. He examines the conflicts inherent in international law - sources, sovereignty, 'custom' and 'world order' - and shows how legal discourse about such subjects can be described in terms of a small number of argumentative rules. This book was originally published in English in Finland in 1989 and though it quickly became a classic, it has been out of print for some years. In 2006, Cambridge was proud to reissue this seminal text, together with a freshly written Epilogue in which the author both responds to critiques of the original work, and reflects on the effect and significance of his 'deconstructive' approach today.

Carl Schmitt S International Thought written by William Hooker and has been published by Cambridge University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2009-11-12 with Political Science categories.

An unrepentant Nazi, Carl Schmitt remains one of the most divisive figures in twentieth century political thought. In recent years, his ideas have attracted a new and growing audience. This book seeks to cut through the controversy surrounding Schmitt to analyse his ideas on world order. In so doing, it takes on board Schmitt's critique of the condition of order in late modernity, and considers Schmitt's continued relevance. Consideration is given to the two devices Schmitt deploys, the Grossraum and the Partisan, and argues that neither concept lives up to its claim to transcend or reform Schmitt's pessimistic history of the state. The author concludes that Schmitt's continuing value lies in his provocative historical critique, rather than his conceptual innovation.
