English summary: The widespread scepticism in regard to politics is a result of the inability to define a clear concept of politics. This is due to the fact that the relationship between politics and power has not been clarified. In Georg Zenkert's study, which takes not only an historical but also a systematic standpoint, the author shows that power in principle develops in three dimensions: power is firstly the ability to act, secondly control and lastly the constitutive power of a group. Each of these dimensions find its own suitable medium in the exchange of opinions, in the law and in institutions. The normative standars of power result from the development of the potential competence to act, the potential achievement of order and the potential integration within the framework of the political constitution, all of which are intrinsic to power. Der Grund dieses Defizits liegt in der ungeklarten Beziehung von Politik und Macht. Teils wird Politik als blosse Machtausubung denunziert, teils als Normierung der Macht uberhoht. In beiden Ansichten erscheint der Zusammenhang verkurzt. In der Tat ist Politik im wesentlichen Machtausubung, aber als reflexive Gestaltung von Macht durch Macht, die eine normative Struktur generiert. Indessen leidet der Machtbegriff unter einer theoriegeschichtlich, insbesondere theologisch bedingten Reduktion auf das Moment von Herrschaft. Georg Zenkert zeigt dagegen in dieser sowohl historisch als auch systematisch angelegten Untersuchung, dass sich Macht prinzipiell in drei Dimensionen entfaltet: Macht ist erstens Handlungsvermogen, zweitens Herrschaft, und schliesslich die konstitutive Macht einer Gemeinschaft. Im Austausch der Meinungen, im Recht und in Institutionen finden diese Dimensionen jeweils das ihnen adaquate Medium. Eine Normierung der Macht ergibt sich dann aus der Entwicklung des in der Macht angelegten Potentials der Handlungskompetenzen, der Ordnungsleistung und der Integration im Rahmen eines erweiterten Modells der Gewaltenteilung.

The U.S. Constitution provides a framework for our laws, but what does it have to say about morality? Paul DeHart ferrets out that document's implicit moral assumptions as he revisits the notion that constitutions are more than merely practical institutional arrangements. In Uncovering the Constitution's Moral Design, he seeks to reveal, elaborate, and then evaluate the Constitution's normative framework to determine whether it is philosophically sound-and whether it makes moral assumptions that correspond to reality. Rejecting the standard approach of the intellectual historian, DeHart for the first time in constitutional theory applies the method of inference to the best explanation to ascertaining our Constitution's moral meaning. He distinguishes the Constitution's intention from the subjective intentions of the framers, teasing out presuppositions that the document makes about the nature of sovereignty, the common good, natural law, and natural rights.
