O autor promove rara e abarcante discussão jurídica, filosófica, histórica e ética sobre a formação da noção de pessoa humana na sociedade, com especial embasamento nas encíclicas da Doutrina Social da Igreja Católica. Conforme demonstra, nos primórdios, nenhuma pessoa era compreendida com a dignidade que lhe é imanente. Apenas com o advento do Cristianismo, tornou-se possível o surgimento de uma adequada noção do conceito de pessoa humana, o qual veio a se tornar o mais basilar e profícuo dos pilares da construção da civilização ocidental. Não obstante, com a eclosão da Revolução Industrial, e a consolidação do Capitalismo como modo de produção, ocorreu um arrefecimento dessa noção. Por intermédio da utilização de máquinas, os industriais puderam produzir com muito mais velocidade e eficiência. A burguesia prosperou; grandes fortunas foram construídas com imensa rapidez. No entanto, o processo também levou à miséria um imenso contingente de pessoas. Em decorrência de sua abundância e baixa qualificação, o operariado passou a ser largamente explorado e sujeitado a péssimas condições de vida e de trabalho pelos burgueses. Dessa situação de formação de dois universos sociais totalmente díspares, surgiu um natural conflito, que logo atingiria toda a sociedade mundial, à medida que o modelo industrial se disseminasse. Procurando ser uma luz em meio ao imenso caos, a Igreja Católica iniciou, então, a composição de uma série de Cartas, isto é, circulares destinadas a todos, com o objetivo de tratar da Questão Social. Após a Encíclica de Leão XIII, a primeira, seriam elaboradas muitas outras; era a voz da Igreja, expressa na sabedoria dos Papas e assentada nos ensinamentos cristãos, procurando, perante seus respectivos contextos sociais, anunciar os procedimentos corretos e necessários à busca de um mundo mais humano. Ademais, marcadas por um portentoso conteúdo social, tais encíclicas têm contribuído imensamente para que, no decorrer do tempo, inúmeros direitos sejam consagrados nas mais diversas legislações, sendo notória a aproximação de seus preceitos a uma extensa série de direitos consagrados na vigente legislação social brasileira. Nos dias atuais, a necessidade de aplicação da Doutrina Social da Igreja Católica continua imensa, uma vez que o egoísmo e a ganância, tão característicos na classe burguesa do início dos tempos industriais, parecem estar ainda mais atuantes. Diversos problemas sociais comprovam esse fato, e a humanidade percorre um caminho obscuro, em que se acentuam, a largos passos: a discrepância de níveis de vida; a exclusão econômica e social de cada vez maiores parcelas da população; o crescimento da violência nas sociedades e entre nações; enfim, os motivos suficientes para disseminar o temor de que a realização plena dos direitos humanos torne-se ainda mais utópica.

Luigi Taparelli, SJ, 1793-1862, in his Theoretical Treatise of Natural Right Based on Fact, 1840-43, presents a neo-Thomistic approach to social, economic, and political sciences grounded in an integral conception of the human person as social animal but also as rational truth seeker. His conceptions of social justice and of subsidiarity are fundamental to modern Catholic social teaching (CST). His work moves away from traditionalist-conservative reaction in favor of an authentically human, moderately liberal, modernity built on the harmony of faith and reason. He zealously deconstructs laissez-faire liberal ideology and its socialist progeny in scores of articles in the Civiltà Cattolica, the journal that he co-founded in 1850. His arguments figure prominently in the Syllabus of Errors (1864) of Pius IX. Though a moderate liberal himself, his reputation as anti-liberal reactionary and defender of Papal temporal sovereignty is the chief reason why Pope Leo XIII later sought to quiet Taparelli's contribution to the foundations and pillars of modern CST that began with the restoration of Thomistic philosophy in Aeterni Patris (1879), and the "magna carta" of modern Catholic social teaching, Rerum Novarum (1891). Pius XI relies heavily on Taparelli's concept of subsidiarity in Quadragesimo Anno (1931), and sought to advance interest in Taparelli studies. However, Taparelli's eclectic philosophical orientation and writing style have been a considerable stumbling block. In this present book, Taparelli's ideas are evaluated both for their philosophical character but also in their historical context. Taparelli's theories of the just society and ordered liberty, are as timely nowadays for reasoned political and ethical discourse as ever. The book includes an appendix of translated portions of the Theoretical Treatise of Natural Right Based on Fact that relate to subsidiarity.
