This book aims to recast the way that philosophers understand rhetoric. Rather than follow most philosophers in conceiving rhetoric as a specific way of speaking or writing, it shows that rhetoric is better understood as a dimension of all human discourse and action—what the author calls “rhetoricity”. This book provides the first philosophical treatment of rhetoricity. It is motivated by two ongoing developments. The first is the debate between Alain Badiou and Barbara Cassin about philosophy’s relation to rhetoric. Both Badiou and Cassin are critical of rhetoric, albeit for different reasons. Second, there has been a growing resurgence of interest in rhetoric considering the recent rise in authoritarian politics as well as new forms of propaganda driven by “persuasive technologies”. This book identifies the common target of Badiou’s and Cassin’s otherwise incompatible critiques: rhetoric’s conception of audience. It offers a fresh take on the “new rhetoric” project of Chaïm Perelman and Lucie Olbrechts-Tyteca, putting their work into conversation with the Badiou-Cassin debate. The book then turns to the hermeneutic philosophy of Paul Ricoeur in search of an expanded conception of audience. It shows that Ricoeur’s hermeneutic philosophy allows us to extend Perelman and Olbrechts-Tyteca’s psychological notion of audience to texts themselves and to argue that human beings have a rhetorical capacity to reflect on audiences in search of what is potentially persuasive. The Rhetoricity of Philosophy will be of interest to scholars and advanced students working in contemporary European philosophy, rhetoric, argumentation studies, and social theory.

This book is a successor to J Griffiths, A Bood and H Weyers, Euthanasia and Law in the Netherlands (Amsterdam University Press 1998) which was widely praised for its thoroughness, clarity, and accuracy. The new book emphasises recent legal developments and new research, and has been expanded to include a full treatment of Belgium, where since 2002 euthanasia has also become legal. The book also includes descriptions written by local specialists of the legal situation and what is known about actual practice in a number of other European countries (England and Wales, France, Italy, Scandinavia, Spain, Switzerland). The book strives for as complete and dispassionate a description of the situation as possible. It covers in detail: - the substantive law applicable to euthanasia, physician-assisted suicide, withholding and withdrawing treatment, use of pain relief in potentially lethal doses, palliative and terminal sedation, and termination of life without a request (in particular in the case of newborn babies); -the process of legal development that has led to the current state of the law; -the system of legal control and its operation in practice; -the results of empirical research concerning actual medical practice. A concluding part deals with some general questions that arise out of the material presented: Is the legalisation of euthanasia an example of the decline of law or should it, on the contrary, be seen as part and parcel of the increasing juridification of the doctor-patient relationship? Does the Dutch experience with legalised euthanasia support the idea of a 'slippery slope' toward a situation in which life-especially of the more vulnerable members of society-is less effectively protected? This book examines the phenomenon of the reappearance of characters in nineteenth-century French fiction. It approaches this from a hitherto unexplored perspective: that of the twin history of the aesthetic notion of originality and the legal notion of literary property. While the reappearance of characters in the works of canonical authors such as Honoré de Balzac and Émile Zola is usually seen as a device which transforms the individual works of an author into a coherent whole, this book argues that the unprecedented systematisation of the reappearance of characters in the nineteenth century has to be seen within a wider cultural, economic, and legal context. While fictional characters are seen as original creations by their authors, from a legal point of view they are considered to be ‘ideas’ which are not protected and can be appropriated by anyone. By co-examining the reappearance of characters in the work of canonical authors and their reappearances in unauthorised appropriations, such as stage adaptations and sequels, this book discusses a series of issues that have shaped our understanding of authorship, originality, and property.

This book argues that moral rights provisions in copyright law rest on a misunderstanding, or romanticisation, of the role of the author. The Romantic conception of authorship, as a lone genius, creating from nothing, sensitive and vulnerable, has helped publishers push for strong copyright reform. But is this conception borne out in practice – especially in a world of meme culture, of artificial intelligence generated art and poetry, and of open source and fan fiction? This book probes the romantic vignette of the author through its legal adoption. Moral rights are rights that attach to the non-economic – for example, intellectual or emotional – interests of an author in their work. Much like defamation, moral rights see the right of reputation as superior to the right of freedom of expression. However, unlike defamation, moral rights are not protecting against defamatory actions against a person. In most jurisdictions, they are provisions set within copyright regimes; regimes whose purpose is to incentivise innovation. Challenging the way we think about authorship and how it should be protected by law, the book draws on a wide range of historical and contemporary examples to demonstrate how moral rights can constitute a barrier to transformative creativity. While authors and artists require strong rights to protect their ability to earn an income and incentivise creativity, moral rights, the book argues, may in turn actually harm their ability to do so. This timely criticism of moral rights will appeal to researchers, students, policy makers and lawyers working in the area of intellectual property law, as well as legal theorists, sociolegal scholars and legal historians with relevant interests.
